After passing a person in "authority" on a country road four months later, the OPP served a notice to appear for careless driving. Proving diligence and care should not be a problem. The only witness are two persons, each one I passed. No cars were approaching in the opposite direction....truthfully, I'm not sure what this power-trippers problem is. After I passed him, he aggressively chased me. I'm looking for recent cases to advocate that passing is not against the law! Thanks.
Thanks for all the support; when I came home, my wife immediately instructed me to document the entire day, which I did. So I have my own written statement here at home. My wife and I also made a compliant to the Military's chief for his conduct that day...they encouraged us to formalize a complaint against him to the commissionaire. We just wanted the money back which cost us to get the vehicle out of the pound. They had the tow truck waiting for me...as soon as they found me. When the chief aggressively pursued me, he was tail gating me. I found it bizarre that he was going below the post speed rate to this point of aggression.

Mail in you request for disclosure. Let us see what they have against you. As to filing a complaint... Not sure where you would send it too, but that is a definite "should do". Why don't you make a call to the OPP to charge the Fire Chief with "Follow too Close"? He had no qualms about ratting you in, even though his case had no merit.

I've requested disclosure. I'll post the results. As soon as I receive the name of the person chasing me, I will phone the opp and make the complaint. If they fail to do anything, I will attend the justice of the peace and get a formal charge that way.

The charge was dropped! After readying the disclosure - very apparent that the fire chief worked closely with the police to construct his statement....Crown must have also seen the numerous flaws.

I'm hoping somebody can point me in the right direction to track down various radar gun error codes.
Way back in March of this year I was stopped for speeding, 86kmh in a 60 Community Safety Zone, on Mayfield Rd., on the outskirts of Brampton. (Aloa school)
My husband was driving my car and passed a school bus with flashing lights. He did not realize this until he was past the bus. The driver honked at him but there were no cops nearby and he didn't get pulled over. I believe the driver or witnesses reported this and we got issued a…

Hi, last summer I was pulled over when I made a left turn from he middle lane at Harbor and Yonge Street (heading east on the Gardiner and taking the Yonge exit). I swear they nabbed about 10 people in 5 minutes. Anyways, I decided to challenge in court, my court date is in April and I have just…
In Kanda, the court established that this offence is a strict liability charge. In other words, you can offer a defence of due diligence. In Kanda the defendant explained the…
Last July I got pulled over for failure to obey stop sign at a T-intersection in my neighbourhood. After I got my trial date I requested disclosure in November. Sent in another request for disclosure in early January and in mid-January got a call to pick it up at the court office. The disclosure…
