I highly recommend everybody have a dashcam and record ALL interactions with police because most of the time the courts will always side with an officers testimony over an accused. If they are doing their job correctly, then they have nothing to worry about. If I walked up to a car and had a cell phone shoved in my face That's nice, but that's not what he said. I'm interested, do you havefriends record your interaction with bank tellers ? Waiters in restaurants ? What made you choose to have someone record this interaction with a professional doing their job.
The bigger question is why anyone who had the ability to do so, wouldn't record their interaction with the police!

The prosecutor said there was no need to have anything sworn, that having the books stamped and serving everyone was sufficient for an 11B application. Is this not true? I just followed the process outlined in this thread. I ended up going through the swearing process a total of 8 times. I swore my statement that was included in the books I had prepared 6 times (once for each book). I then served the book on the prosecutor and had all 6 copies stamped leaving one with them. I then faxed a copy to each of the attorney generals and made a copy of the 2 fax receipts. I then went back to the comm...

Thanks diehard - but I guess my question would be - how do you prove they got the fax? What if they say the fax was never received? How do we prove they got the fax without having their stamp on each book? PS: The books are already printed and we paid Staples to Bind them so dont really mind so much having to get the stamp, but it sucks that the only options are Ottawa or Toronto?? The stamp for the Attorneys-General is not essential. But you must keep the fax receipts, that is very important to prove that they have been served. Just Curious. If it said "Hurontario Street, Dufferin County" would it be fatal? Make that 2 Victories as a result of the information published on this site! I filed an 11b using the process provided here a couple of weeks ago. When I attended POA court this week I watched the usual process as a long line of people pleaded guilty to lesser speeding charges. I had everything ready to defend my 11b and if it failed, I had my trial information prepared. I asked the prosecutor whether the officer was in the court and was told "yes" so I assumed I was going to have to go through with the whole process. When they called my name however there were no police in the court...

Carol, may I ask what sequence you followed? Did you find any obstacles while serving the Prosecutors and Court? Basically I used the process that you and Radar Identified described at: http://www.ontariohighwaytrafficact.com/topic2952.html You guys have done a wonderful job of clearly describing the steps and I had no problems following it. Funny enough, every step of the way I was asked when the trial date was and when the person being served realized it was more than 15 days away, a disappointed look came over their face. 11b Filed ... Now What?
I have been following the process for correctly filing an 11B and now need to know what occurs at the actual trial itself. I understand that if the trial begins and no mention is made of my 11b application, I am supposed to remind the Justice of the Peace of my motion. Once they acknowledge my motion for adjournment do I have to read it out loud or read my statement as to what occurred or do I just wait for the Justice of the Peace to speak? Does my request do all the arguing for me or do I have to make my case? I am assuming the Prosecutor will have something to say and will try to have my mo...

Do I have to include the complete "ASKOV et al v. R. DECISION" and the "R. v. MORIN DECISION" in my NOTICE OF APPLICATION FOR STAY OF PROCEEDINGS package or just the first few pages of each?
They are both very long and an example of a package I have, seems to just use the first couple of pages containing everything up to the "Statutes and Regulations Cited" section.
