Re: Officer establishing traffic history re: Speeding
You're still going to be left with the actual device's readings in evidence. So, if the officer testifies that he/she locked the vehicle with the device within the new speed limit zone, then even if he did not conduct a proper visual estimation (or none at all!) within the new speed limit area, the...

Re: Officer establishing traffic history re: Speeding
First of all the term is tracking history, second depending on the manufacturer of the radarl/lidar there is no requirement to perform a tracking history in most manuals. However, it is still taught and there is no requirement to estimate the speed of a target vehicle. It is sufficient to state tha...

Re: Officer establishing traffic history re: Speeding
There's no fixed standard. Each officer will clearly have a different threshold---some will be able to estimate speed farther than other. Plus, there are several variables at play such as the distance of the vehicle from the officer, weather, lighting conditions, curves/bumps in the roads, etc. Reg...

Re: Officer establishing traffic history re: Speeding
The scope is designed to help an officer aim the laser unit at a specific target in order to line up the beam, and isn't capable of "extending the officer's ability to see" further. A laser unit has a maximum range of 9,000+M, while the officer's visual acuity has a significantly lower ran...

Re: Officer establishing traffic history re: Speeding
With regards to traffic history: If a laser unit is meant to be nothing more than a corroborative tool, the officer must first rely on his/her visual acuity to perform a traffic history, correct? Having said that, when the officer observes traffic how far away can the officer claim he/she is qualifi...

Re: 145KM/HR IN 100 POSTED HWY 401
If the disclosure doesn't mention whether the officer performed a check of the laser unit at the end of the shift, can that be called into question at trial?

Officer establishing traffic history re: Speeding
At about what distance relative to his position (standing still, observing traffic) can an officer make a determination that a vehicle approaching is traveling at a certain rate of speed? When the officer takes a traffic history and makes a visual assumption about speed, but does so after the laser ...

Re: Disclosure (clarification)
If you received an electronic ticket (i.e. the ticket itself is typed) then there are no hand written notes, only the typed ones. A copy of the ticket itself is irrelevant unless the officer made notes on it. I would say your disclosure is only incomplete if handwritten notes do exist and weren't p...
