I can just tell by the way the way FedUpTrucker is talking that this guy is one of these cowboy truckers that put other people in danger on the road to save half an hour of time. I think its pretty known that people "routinely" break the law of 100km/hr maximum speed. Don't you remember the high profile case of two drivers doing 100km/hr on the 401 driving side by side in the left and middle lane to protest a ticket he received earlier that month for travelling 115 in 100km/hr zone. They were both charged under this section. So no, it is not okay to travel at 100 km/hr in the far left lane. I am looking at this issue from purely a safety and traffic management stand point. Here's a very interesting link showing how each state in the United States deals with the issue of enforcing this law. http://www.mit.edu/~jfc/right.html The bottom paragraph is very interesting when it talks about transport trucks doing 60mph in a 55mph zone when traffic flow is travelling @ 65 mph and police will actually ticket the transport blocking the left lane doing 60mph. Hence the problem with the section Simon. You must agree that it is quite dangerous for a driver to drive in the far left lane @ 100km/hr. Passing in lane 2 and/or lane 3 causes many accidents on our roads. This article I referred to though suggests that it's officers fault for not properly enforcing this violation when in fact there is no violation. Exactly, no one knows about this cobalt ss 2009+.
Someone in a BMW, G35 or AUDI rolls up on this cobalt and laughs when they rev the engine but then gets spanked and assumes the car has 20k+ of mods when it is actually bone stock and just simply out performs a lot of very expensive cars mid-range sports cars.
You have to look at the overall cost though, is the increased purchase and maintenance price of a BMW/infinity worth the savings on insurance?

Although this article doesn't give the details, I guarantee you this was a Cobalt SS 2009 or newer, it is probably the best sleeper car under 30k you could buy (discontinued, replaced by the Chev. This ticket is not worth fighting at all. The police officer more than likely did clock you at 140+, easily too, if you did approach him at a high rate of speed during low volume of traffic it would be hard to not have noticed your vehicle in his rear view mirror and his radar display in the front dash reading 140+. He did you a great favour probably because it was your first offence by reducing the ticket to 105. If someone was dialling on their phone, on the keypad, but got pulled over before the call could be completed then there would be no way for the accused to prove he/she was dialing and not texting because no record would show on the phone bill of a call being connected. Bear you make a good point, I think if police use common sense it shouldn't be a problem. I have seen some horrible drivers that like to put their phones up on the steering wheel so they can use their thumbs on the phone and fingers on the wheel. Actually the law reads that the device could potentially be sitting "securely" in a cupholder. Because the device would not move during motion of the vehicle, whereas if it were sitting on a persons lap or on the passenger seat it would be movable during motion.

The problem is exactly what Squishy said, the HTA law says if the cell phone is "mounted" to the vehicle in some form (you can buy one of the AC/Heat ventilation mounts from Walmart for 20 bucks) you can press as many buttons on it as you wish, same goes for the GPS mounted units.. This law is severely flawed albeit a step in the right direction. Don't get me wrong I despise people who text and drive. Being a motorcyclist, distracted drivers are the greatest threat to my life while riding. Our Country is so dependant on transport trucks that limiting their usage along the main transportation sector of our province (400 series highways) will never happen.

The officer had a blackberry smart-phone so I can only assume he had access to 3 or 4 G coverage to do a quick search. I understand about the visual inspection and that makes sense to me and I didn't think of it at the time, although the officer knew my helmet was brand new.
