Re: Distracted driving - I'm fighting - but I never got a court date

Not sure you'll be successful with the touching the phone argument. I would imagine the counterargument would be that you should have securely mounted the phone in a position much higher up than a cup holder and that looking down at the phone in the cup holder is in fact dangerous. Good luck

Ignorance of the law is no excuse. I doubt this argument will work

What was the original charge (the charge before the offer from the prosecution)?

Re: Careless Driving Summons for Rear End Collision

Thank God for the Partridge. As an LEO I always lay the Careless. But I never get a court slip for trial. It always and I mean always gets negotiated down. I recommend early resolution and see what the offer is. Likely follow too close. If it always gets negotiated down then very simply you're layi...

Re: Drive Motor Vehicle No Currently Validated Permit (is it a moving violation?)

K so I called an insurance company anonymously to inquire and the individual said it results in a "minor conviction," and that indeed it will result in an insurance increase. So I keep hearing that non-moving violations don't result in an increase but this doesn't appear to be true. Any e...

Re: BAC >0 G2 and more.

You knew the rules and you broke them. The situation has no bearing on things and does not need to be considered. What you need to do now is try to find a way to minimize the effects of this charge, and if I were you I would not bring up the situation as you described it at all - no one will be symp...

How can you say you don't deserve this? You chose to drink the sips of alcohol and then chose to drive.

Re: LED lighting

actually did a little perusing on the web is constant , green or amber allowed ? Why would you want to add extra lights that only serve to draw attention to your car.? I like to be as inconspicuous as possible. As far as green, I know that's the colour used by volunteer firefighters. Amber should b...

Re: No Insurance Accident, Please Advise

That's a long winded rant and I'm sure you feel you've accomplished something by writing it but at the end of the day what you did was not a mistake. I make mistakes all the time. I occasionally forget to take my drivers licence with me when I drive. I occasionally make mistakes in my work. But you ...

Re: Definition of a U-Turn

This reminds me of another question regarding private driveways: if you are waiting to turn right but there is a long line, and also a business like a gas station at the corner with entrances on both roads, it is lawful to "skip the line" and go through the parking lot? I don't see why it...

Re: Summons 3 Hand Held Device

I would not imagine that the court will go easy on you given your record of prior use of hand held device convictions and that you flipped off the officers. So unless there is a fatal error on the ticket or if there is something in the officer's notes that will help my guess is you will be convicted...

Re: Police Entrapment

Your thread title indicates you think this was entrapment by police. It was not. As for it being entrapment by the other driver, I don't believe it is. For this to have been entrapment the police officer and the other driver would have had to colluded to convince you to pass. Which means the officer...

Re: Ontario reintroducing Photo Radar/Speed Cameras?

Has there been a series of injuries and fatalities in school zones recently that has prompted the cameras? I doubt it! It's all about income generation... tax the people until they revolt! No doubt there is the lure of revenue that is appealing to authorities with photo radar. But I think there is ...

Re: can you still get a ticket ?

If he was going to get a ticket, they would have pulled him over right then. 120 on the 400 is not going to make them sit up and take notice unless the weather conditions are bad...They are looking for the high milers... Agreed. In good weather I always set my cruise to 120 on the 400 series and I ...
