Re: Speeding ticket for going 60km in 50km zone. Worried about insurance increase :(
Thanks Zatota, this is very helpful. Interesting how these things work. I will have to give it some thought..without knowing the court date I will have a hard time ensuring I can find someone to act on my behalf. Anything past September should be a non-issue. Would you know what the average wait time for trial? Thanks so much to both you and argyll ...

Re: insurance renewals
argyll, that's very interesting. my objections to participating were strictly 'gut feel' and i'm glad to see some concrete pitfalls. I didn't even bother to try to find out what algorithm they would be using, it just gives me goosebumps just to think how easy it would be to use that feature against a client. It's naive to think that it is practical ...

Re: Speeding ticket for going 60km in 50km zone. Worried about insurance increase :(
Thanks agryll, your reply had exactly the info I was looking for. So you're saying there will be an opportunity to just go and pay the ticket as if I never asked for a trial? Won't the prosecutor/judge question that and raise/add fines for their trouble? good point about the time, but..can I get a friend or family member to act on my behalf?

dude, may i ask what insurance company you're with? how is it that you had to prove your innocence, I thought they had to prove your guilt! I've seen offers for the app that monitors your driving and I can't say I am excited about yet another surveillance coming into my life, discount or not.

Re: insurance renewals
bobajob, thanks for posting, I was looking for insurance impact as I just got one minor (10KM over) speeding ticket, first one ever and I am concerned about the increase. Is the increase 5-10% every year or just a one time thing that carries for several years? How many years did it take for your ticket to come off the books?

Re: Speeding ticket for going 60km in 50km zone. Worried about insurance increase :(
Thank you Zatota. Yes, the officer said I was going 71. I didn't think so but then I don't keep my eyes peeled to the speedometer and I was passing another car at the time. My understanding is that 10km over means no demerit points but at 21 over there would. As you said, if I decide to contest the ticket and lose, 71 is likely to be used so ...

Speeding ticket for going 60km in 50km zone. Worried about insurance increase :(
The fine is not the issue but I am worried about insurance rates. First speeding ticket in my life
Any suggestions on how to handle this? I can't afford to spend a day at the court

Re: 66 in a permanently-posted 40 kph zone/CSZ
So, part 3 would be issued immediately for serious offences but can be issued later for a ticket that was originally issued under part 1 or 2? in other words, i could be summoned to court for speeding 5km if the officer failed to file the ticket within 7 days?

Re: 66 in a permanently-posted 40 kph zone/CSZ
rayinbarrie, I don't know what the relay note means but my guess would be that the officer might go back to the court/judge and request that the ticket not be dismissed. Ticketcombat says ' A police officer has seven days to file all the traffic tickets he wrote.' Maybe the officer was sick or had some other issue that prevented him from filing on ...

Re: 66 in a permanently-posted 40 kph zone/CSZ
The only trial I've seen was a disaster for the defendant but she had completely no clue what she was doing and instead of cross examining the officer she kept on repeating she wasn't going 'that fast'. It was a short trial. I was prepared but the officer didn't show so I didn't have a chance to test my defence strategy. Hopefully if you decide to ...

You might find the sample disclosure form mentioned here http://www.ticketcombat.com/sitesearch.php listed under sample forms. In fact the entire site is excellent and worthwhile going through in its entirety. If you decide to do that, make sure you follow the forward arrows at the bottom of each page not just the tabs on top.

OPS Copper, thanks for the clarification. I didn't see any mention of summons just the ticket and didn't research fines. If it was summons my comments re contesting are irrelevant.

Re: 135km/h in a 90km/h zone on hwy 17
Hard to say if you got a better deal than going to trial but definitely better than the original charge. Seems like you might have had a nastier than usual JP so odds are she might have not been very sympathetic had you decided to go to trial. Normally, I would expect an adjournment because of non-disclosure. It isn't right for you to have to go to ...

Re: Test drove without insurance...
What Stanton said. When you get to court to try your case the 'criminals' line up to see the prosecutor. At that time, in every case I saw at least, the prosecutor offered a deal. It goes something like that, 'hmm, you are charged with xyz, I can offer you abc, do you accept?' In order to be able to do that you have to contest the ticket, i.e. pick ...

Re: Wrong speed written on speeding ticket
Don't think it fatal but could be used to shed doubt on officer's side of the story if it came to trial and presented along with other arguments. By itself however it is unlikely to sway the JP. If you strongly feel that the ticket wasn't justified you might go on a limb and try to fight it in court but you'd need more than just his word vs what he ...

Re: 135km/h in a 90km/h zone on hwy 17
Agree with Stanton, I don't think the court would accept the passing as justification for speeding. It might be possible to get out of the ticket that way at the time you are ticketed because it is the officer's call as to whether to issue a ticket or if you manage to talk the officer out of it before the trial, but once you're in court it is up to ...

Re: Unaware of 3 month Quebec suspension, with BC license.
Myner, just to clarify, you drive a car with Quebec plates but your driver license is from BC? interesting scenario. I thought demerit points went with the license, not plates. Even then, according to SAAQ license suspension should not occur until 8 demerit points and you had only 6 so it makes no sense http://www.saaq.gouv.qc.ca/en/driver_licence ...

That's odd. It is supposed to be a Genesis Decatur handheld. Any idea if the unit comes with one of those clear protector stickers that have a pre-printed image and need to be removed prior to usage?

Re: Prosecution refused disclosure for speeding charge.
Thanks Stanton. I was pulled over the officer showed me the radar and the speed was displayed on the left, i.e. the large display. I didn't notice what, if anything was on the right. Under what circumstances would there be a number on the left when the radar wasn't transmitting (well, I'm assuming it wasn't transmitting otherwise the stationary me ...

Re: Prosecution refused disclosure for speeding charge.
Decatur, you seem to know about radars (hence the name?) so maybe you can help me. The manual for the Genesis radars states that when you lock the speed it will move the speed to the right display and lock it in and as long as you continue to hold the trigger the radar will continue to track targets and show their speed in the left side of display ...

Re: Prosecution refused disclosure for speeding charge.
Ejadoo, the only ai-013 I found is here http://www.docstoc.com/docs/66799986/Ontario-AI-013-Speed-Detector-Devices but decatur says it has been amended in 2011. I still think it's a good reference as it matches the DOT documents listed on some recent police boards. Also, if you were ticketed in 2011 it could actually be the relevant one. I don't ...

ejadoo, re ai-013, decatur is right, there is only one. Unfortunately I wasn't able to find it, from an official source at least. This info should be available to public at large; we shouldn't have to waste hours surfing ...

lol ejadoo, only too true! unfortunately the courts rely on precedent to decide cases so in reality decisions are made by a few select judges and the rest follows or has to follow? I'm not sure if I judge can successfully rule against a precedent. thanks for the link

Decatur, you mentioned several interesting topics.
1. Tuning forks. My argument is not regarding the usage of the forks, but the lack of mandatory equipment which is not supplied with Canadian units or even mentioned in the manual. If Ontario didn't require adherence to NHTSA standards that would be a different thing but I have evidence that it ...
