Re: And another reason to strike down S.172

Guess your not following this too closely....this practice has also been done by the Windsor Police, Thunder Bay Police.

And it is not jury rigging at all. An example of that would be putting people on the jury who have all had someone killed by an impaired driver in a impaired driving causing death case.

To my understanding is the crown was ...

Re: Cop suspended with Pay, HTA 172

this is in no way a shock to all of us who saw this coming back when Frank Klees emotionally drafted his ill-thought private members bill, blaming his drunk driving constituent's death on a pair of young guys speeding through an intersection

terrible law.....and the endless stories in the media keep proving it over and over

Re: JP rules - HTA172 violates the charter

Fantino has been an excellent leader for us.

are you sure about that?

personally....since old Julian has been on his HTA crusade BSing stats along the way....I've about lost any respect I had for the guy in the first place - which wasn't that much to be honest

his bullying....and his endless court appearances defending himself constantly for ...

that article is from 7 days ago...and apparently, the JP in the case just made recent case law?

Re: JP rules - HTA172 violates the charter

I'll pull out my tennis ball (can't afford the crystal ball) and gaze into the fuzzy side ...

The ball is predicting that the future holds a change to part of the act.

The vehicle impoundment part will be removed, but the 7 day suspension will stand.

I'm trying to understand how this all works. Is there any correlation between the potential ...

Re: JP rules - HTA172 violates the charter

^^^^ problem with your argument Plender....is that the HTA already had/has laws governing "speeding".....and those offences under the HTA are supposed to be absolute liability....172 tries to blurr the lines between the HTA and the CCC....let alone tries to give new meanings to age-old definitions

anyhoo.....a JP agreed and has stayed a case of ...

JP rules - HTA172 violates the charter

about time some sanity came about with regard to this farce

nice to see a JP that actually understands the laws they're paid to uphold

Re: Section 172 of Highway Traffic Act (Sunts) - Examination

tdrive - I'm surprised you're just discovering these details now

the details in section 172, that the media don't highlight....aside from the oohh/ahhh 50k over.....are the main reasons to have the whole enchilada repealed

it's pretty obvious what the written details in 172 try to imply....but IMO, all of those descriptions can be easily mis ...

Re: Driver clocked at 250 km/h

lets look at some history folks

12 years ago, your Canadian Gov't via it's Postal service released a stamp of one of the Country's noted heroes

pretty cool honour eh? getting your mug on a Canadian stamp is some serious props

Re: Driver clocked at 250 km/h

To my understanding of Dangerous Driving, speed alone is not enough, there has to be other factors involved, but I could be wrong

appreciate the response

is does give credence to some thought I've expressed on other forums

that thought was that there was a time not too long ago when getting nabbed at that kind of speed could have been given ...

Re: Driver clocked at 250 km/h

question for Bear,

How come this guy wasn't criminally charged with Dangerous Driving?

I know of many motorcyclists that have been brutally thrashed by 172 for the likes of lifting the front wheel for a second (leaving a light...not catwalking down the hwy at 140 .lol) or lane splitting.....a bit hard to swallow when a guy going 2.5 times the ...

Re: People are Driving Faster

130km is a fatal zone line.......people are not developed to with stand sudden stops at those speed. Their organs can not take it and they obtain serious injuries and some often die..

hence the reason why draconian penalties for the "magic" 150 kph on controlled access highways is a complete wank.....because nobody is face planting at that ...

Re: People are Driving Faster

Do you know why the police were there? I think not. Many reasons to be on the hwy parked behind vehicles.......but never would want to lay blame on those "rubber neckers" or other poor driving.

well....I passed one marked cruiser first....he was just idliing on the shoulder....then about a km down the road there was another marked cruiser ...

Re: People are Driving Faster

I drove the 401 yesterday from Toronto to Kitchener and back

I've generally had the same driving behavior for decades - "try" to keep her under 120 (115 is the target....thinking I'll not get dinged)....stay right except to pass

Not gonna pretend I've never legged a car out on a deserted stretch, or been a left-lane bandit in a rush....but ...
