Well, my questions have been answered so I guess this thread is pretty much closed. I can honestly say I have never been let off with a warning. Even when the officer was in the wrong they gave me the tickets and I can promise I was quite pleasent. I know my attittude towards the police was soured when I was working downtown Toronto and I was issued a ticket against my license for a parking sign. At the time the police were hiding around corners and waiting for delivery and service guys to jump into their vehicles. As others have said, be polite and hand over your licence and vehicle documents when asked, but watch your self to make sure you don't say anything incriminating. My goal during a traffic stop is to be as forgettable as possible so that come court time the cop doesn't remember anything about me except for what he has scribbled in his notes. If you get into a big argument with the officer, he is much more likely to remember the details of the stop and he will probably take excellent notes so that he can nail you in court. What Can I say to the officer during a traffic stop

Recently my mom was pulled over and the officer threw the ticket at her and told her "see me in court". I was for a expired stick, which I advised her she should change and also film a cop when pulled over because of situations like this.

Anyway, my questions are:

1. Can you swear at the officer during a traffic stop?

2. At what point can an officer order you out of the vehicle?

Has anyone used french court in Hamilton or the GTA?

I would like to know if it is worth trying out or not. Do the officers show up for those trials?

I have had a dashcam for many years. It has come in handy a couple of times as I drove a commercial vehicle for a while. Once I had a guy lay on the street infront of me and Yonge and Dundas and claim I hit him. The cops were laughing already as they walked over, so I mentioned I had it on tape and they just reviewed it, I gave my information, but never hear another thing. During the Pan Ams I had a pass to be in the HOV lanes and was pulled over by OPP. He came storming over, clearly annoyed that I was in that lane. I also recorded the phone call of her telling me she had the disclosure package, so I can use that to prove that they had it, but I only have my dash cam video of me pulling into the courthouse on February 27th as I know I cannot film on private property.

As I stated in another thread, my wife will not be attending. My main question now is whether she has to be present for me to stand up and say that I never received her disclosure as her representative. The Last time I was in court, the Judge asked if she was present. Since they lost my disclosure I would imagine that I will stand up and tell them I am not prepared to proceed as my disclosure was never sent. I think I may have gotten lucky today.

I called 2 weeks ago and they said they had my disclosure package ready. I showed up in person to pick it up and they said they lost it and would have to re-request it. Considering my trial date is March 9th, I am guessing I don't have to continue chasing the prosecutor after 2 requests, and 1 phone call?

The lady at the window refused to sign an affidavit that I was there but I took down her name and what time I was there.

I guess I could argue that I was actually ready last time as my wife was there. The JP asked if she was there, I said yes, then was told here was my new date. I never even told them I did not receive my disclosure yet, never got the chance.

I understand now why I could not file both. Thanks for clarifying that.

The courts have decided that it it is YOUR responsibility to check if disclosure is ready and it is NOT the prosecutions responsibility to inform you that it is ready. Sometime they do send it and sometimes they do contact you to let you know its ready, but they do not have to. If it is ready but you did not call to check, then the delay will be counted against you and not the prosecution. Not saying that I agree with all this, but this is what the courts have currently decided. I will call them ahead of time and ask as usual. I faxed them with my address. I don't use a cell phone and would prefer to be contacted by mail. I would gladly pick it up if they were to contact me. City of toronto actually sent me a letter letting my know my disclosure was ready not sure why peel wouldnt.

Yes, I kept the fax receipts. I didn't use their form so I am guessing as I did not put my phone number means they do not want to answer it.

I filed for disclosure on June 14th and January 10th.

I will see if I get it or not.

I never got to speak to the prosecutor regarding my disclosure at my last trial date. She didn't want to hear anything from me and I just got a new trial date. Because I did not mention it can I still use it in court?

My main issue is now that regardless of whether I get disclosure or not, I still cannot proceed as my wife cannot be there. She will have just had a baby or will be just having one, so I am not sure how to approach this as you are saying 14 months is acceptable.

I still think I can win in court as the office made up a HTA law on the spot, but my wife cannot attend to defend herself.
