So... I plead not guilty... the prosecutor sent me my disclosure today. My court date is on Thursday Morning at 9:30am. I live 3-4 hours away. In the disclosure was 4 pages. 1) my notice of trial paper (which I received a copy in October) 2) a copy of the ticket 3) the officers notes only 1 page(and his business card) 4) A copy of my drivers abstract This doesn't seem like much. The prosecutor says he is going to go for the full amendment and he is unwilling to negotiate the ticket whatsoever. I should note I don't have legal council as they wanted almost $600 and well... the tickets are only ...

If you plead not guilty and send your tickets to the court. How do you get the disclosure?

The speeding ticket will only be amended up at the trial; not when you choose not guilty on the back of your ticket. So, other than time and effort, there's no consequence for choosing the not guilty option on your ticket, and getting your disclosure before deciding whether to pay it or continue fighting it. Yeah that's what I was told. I have like 8 police officers in the family and even an retired JP. I finally broke down and asked one of them last night for some advice. If you plead not guilty your speeding ticket will be "amended up" as per the Winlow decision (Ontario Court of Appeal decision). So, you'll be facing the original speed of 131 in a 90 zone. In other words, 41 over (which is 4 points). Your insurance slip charge will stay the same. The officer gave you a fantastic deal. There is not much chance of you doing better. The only way to do better would be if the officer doesn't show up (which is extremely rare now and would require you to attend court that day--costly!) or if the Crown really screws up (e.g. not give you disclosure, office...

I apologize. I forgot to put the speeding ticket in the OP. Yes, he reduced it to 104 in a 90 zone which is no demerit points.
Like I said I just want to know if there is anything I can do to have the ticket quashed. Lime I said, don't care about the money aspect it's the record on my Abstract that I need to have clean for work.
Or if I fight this am I looking at just ending up having both these tickets amended to the original infractions and mami g things worse?

Hi, 1st offence since 1999. I have had an impeccable driving record since I got a speeding ticket when I was 19. Learnt my lesson and drive like a gramps. However mistakes do happen.
