Fatal Error for Incorrect Total Payable - Speeding
Hey Guys, It's been a while since I've used this forum (Haven't been charged with anything in 3 years, so I've cleaned up my act.) Yesterday, I was pulled over and charged with Speeding 130 KMH in a Posted 100KMH zone on the 401. The officer was nice and polite, as I was with him, and charged me accordingly. However, when I did the math, the Set Fine should be $180 and Total Payable should be $220. On the ticket, its listed as $180 set fine and $200 Total Payable. If I ignore the Ticket, can I still use London vs Young 2008 to get it quashed? Or has case laws changed since I've last been on he...

Re: Electronic Proof of Insurance Cards - accepted by LEOs?
Question regarding "format approved by the superintendent". My Insurance slip expired a couple months ago, and I did not receive the updated slips, so I called my insurance company and they emailed me a valid slip, which I printed out. Would this be sufficient enough, or does this technically not count as an approved format?

Re: class g1 driver unaccompanied by a qualified driver
There's been times where I've thought the cop wasn't the one who pulled me over. Maybe he got a haircut, or glasses or something. But Badge Numbers never lie. I personally would consider this a win and move on. In your original post, you never mentioned the Fail to Surrender Driver's License Ticket. What I'm assuming that happened is that you got caught driving with your out of country license, they ran the name in the system and saw you had a G1 in Ontario. The Fail to Drive with Accompanied G is a Big Conviction, so you're lucky to have that one dropped with the Fail to surrender. Also, This...

Re: License suspended after lost ticket, ways to delay?
@JSherk, I think the OP is getting confused with the Ministry Interview and the Novice Driver Escalating Sanctions. With the Ministry interview, you will have to go in and plea why your license shouldn't be suspended (6-9 points for G1/G2, M1/M2, 9-14 for G/M), where as with the Novice Driver Escalating Sanctions, it's an immediate suspension. On the bright side, after the 30 day suspension, the 4 points will come off your record.

Re: License suspended after lost ticket, ways to delay?
Unfortunatly, there is no way to delay it. What was the charge for? You said speeding, but did not say if it was Stunt Driving reduced to 49 over, or you just flat out lost at trial for a 30-49 over. Either way, the only way for it not to get the suspension is to win at trial, which you were unable to do. The suspension starts immediately, and does not finish until 30 days after you surrender your license. I figured that out the hard way when my brother got caught for driving under suspension. He got the Novice Sanctions suspension, but never surrendered his license. He was borrowing my car 6 ...

Re: Failure to stop at red light turning right
From My Understanding, You can only request an adjournment before the trial starts, since that's what your adjourning. I don't believe you can question the officer pre-trial.

Technically the van has the right of way, but should have turned into it's lane. I can see this being a 50/50.

Re: Speeding ticket - court in 10 days
So the ticket was reduced (Code R), which means that if you take it to trial, the ticket would be amended to the original speed recorded (whatever it was he/she told you). Be aware that 1-49 over hold the same bearing as insurance is concerned, the only difference is 1) points (if you have a lot on your record like me, you want to avoid all as possible, before you hit your suspension), and fine. Also, this offence carries 3 demerit points. If you were doing more than 29 over, that would be 4 points. If you have a G2, if you receive a charge for 4 points or more, your license will be suspended ...

Re: Careless Charge - No Accident
Ok guys, Update here. Had my trial yesterday. Spoke with the prosecutor before hand, I told her I was ready to proceed, and she said she was as well, and didn't want to offer me a deal. Officer was in attendence. There were 10 careless charges on the docket, most of them plead guilty to either "Unsafe Lane Change" or "Improper Left/Right Turn." Court had a break, where the prosecutor offered me a deal for "Unsafe Lane Change" which I responded "No Thank You, I would like to proceed at trial." At the end of the break, prosecutor spoke with me and the offi...

Re: Careless Charge - No Accident
So I never took down the video, Unsure of why it was removed. Anyways, due to the severity of the charge, I think I will just seek a plea deal out of it. I was never willing to fight this one on my own (was going to hire a lawyer), just wanted opinions on whether I should accept a plea bargain (something I could do on my own), or hire a lawyer to fight it (if it showed that it was a great chance it could be beaten).

Re: Ministry Interview
It actually isn't as bad as it sounds. I went in 15 mins prior to my meeting, had a seat. The MTO representative called me in, I sat down. It proceeded with numerous questions (How Many KM do I drive a year, Occupation, Do I need Glasses). After that, she asked how many offences I have outstanding which I told her, then she went through all of my offenses in the last 3 years and asked the reasoning behind them. Most of them I said I was being idiotic, young and stupid, but I am working on becoming better since driving is a privilege, not a right, and without this privilege, my life would be ve...

Ministry Interview
So I received a letter today saying that I need to meet with the Ministry to discuss my driving record. The standard 9 points interview letter. Currently, I have 4 points on my record, but I hit 9 in September (5 points expired that end of that month, and I got convicted of a 49 over which put me at 9). So what I'm trying to figure out is what happens at this meeting usually? Any info would be greatly appreciated.

Missed Trail Date
So I know this is very unprofessional, but I missed my trial date. I had the noticed posted on my fridge, thought it was September 30th (tomorrow), turns out it was September 20th! Anyways, am I at a lost cause here? I know theres probably no chance of me getting another trial. Maybe a reduced fine or something? Any advice is appreciated.
Ticket was for 49 over (not reduced, 109 in a posted 60).

Questions regarding HTA 78 & 78.1
Little argument that came up in work today. I personally don't know the answer, so I thought I'd ask here. So according to the HTA 78.1 78.1 (1) No person shall drive a motor vehicle on a highway while holding or using a hand-held wireless communication device or other prescribed device that is capable of receiving or transmitting telephone communications, electronic data, mail or text messages. 2009, c. 4, s. 2; 2015, c. 27, Sched. 7, s. 18. So I see how it says while holding or using, so my coworker said it was completely legal if it is mounted. I stated how it shouldn't be since the Act spe...
