Duty of drivers when school bus stopped

(11) Every driver or street car operator, when meeting on a highway, other than a highway with a median strip, a stopped school bus that has its overhead red signal-lights flashing, shall stop before reaching the bus and shall not proceed until the bus moves or the overhead red signal-lights have stopped flashing. 2017, c. 26, Sched. 4, s. 21 (1).

It's legal, although not usually practical considering the potential for foot traffic.

The laws regarding school buses always use the term "when meeting" for vehicles travelling in the opposite direction or "when approaching" for drivers coming from the rear.

Your vehicles never "meet," therefore it's legal.

Your option is to live your life.

If they ever plan on charging you, the owner of the vehicle, which may or may not be you, will receive the ticket since they don't know who was driving.

When you're charged as the owner and not the driver, it's a glorified parking ticket.

In terms of insurance, offenses are placed into three separate brackets. There's "minor," "major," and "serious." All offenses are divided into these categories and are treated the same. Careless driving and stunting both fall under the serious bracket. In terms of insurance, there's going to be no difference whatsoever. The absolute ideal offer for your particular scenario would be speeding at anything below 40. It would be considered minor and would likely be the difference between driving again or taking an uber. If that ever becomes an option, take it and run....

The government provides school bus drivers with a form they can fill out for illegal passing of a school bus. If there is enough information for a charge, an officer will write up a ticket and deliver it to the residence of the registered owner. The registered owner of the vehicle, which may or may not have been the driver during the incident in question, will receive the ticket. They are charged as owner of the vehicle, not the driver. Didn't you have this same situation less than a year ago? If I'm understanding correctly, you made a right while another vehicle was making a left and instead of them staying in the left lane while completing their turn, they moved to the right and hit you? The issue is usually that most people here are looking to enter the plaza directly to the right so they immediately jump to the right lane instead of staying in the left, which is illegal. This can get confusing because I think a lot of people watch YouTube videos from the USA and assume probable cause is an element for a traffic stop in Ontario.

It isn't.

Police in Ontario can stop any vehicle at any time to check for:

* License, registration, insurance.
* Fitness of vehicle
* Sobriety, which since 2018, now includes a breath test.

They do not need a reason to do so and can be done at random.

What the officer did was completely legitimate.

Long story short, the courts have ruled that driving is a privilege, not a right, and that these are issues of public safety.

When did you receive your Notice of Trial?

You requested disclosure 1-2 months before your court date. It's not exactly what they'd consider an ample amount of time for turnaround on your request.

What will likely happen is they'll offer you a copy on your court date.

They'll probably push to proceed, you'll argue that you need time to prepare, and then your court date will probably be pushed back.

Probably should invest in a dashcam after this one.

This is one of those situations where you're probably more likely to have this case dismissed based on a witness not showing up than anything else.

Wouldn't exactly be a bad thing to request a trial and go from there.

Remember, the charge under the highway traffic act and your insurance investigation are two separate things. Even if, lets say, a witness doesn't show up and they can't proceed with your case, it doesn't mean your insurance will see things the same way. They'll assess fault regardless based on the evidence in front of them.

Any updates?

Any unpaid fines against your license would've almost certainly resulted in an automatic license suspension.

Unpaid parking tickets maybe? Usually, they wont let you renew your plates until you pay the outstanding fine.

You can purchase an abstract directly online that will show any convictions from the last three years.

Do you have some more information regarding your ticket?

It's quite unusual that someone would want to prove their windows are tinted.

Did you receive a ticket for the rear windows or all windows? Tint laws apply to the windshield and the front driver and passenger windows. They do not apply to any backseat or rear window.

It's not a legal defense that you purchased the car with tint already applied. That is if we're talking about the front windows.

If an officer didn't pull you over at the scene, you will be charged as the owner of the vehicle and not the driver. Whomever the vehicle is registered to will receive the ticket. The ticket follows your license plate rather than your drivers license. Just because you may happen to own that vehicle, it doesn't prove you were driving at the time of the incident. That's why they charge the owner. When you're charged as the owner, you can treat it like a parking ticket. I believe the fine is around $400. There's no points nor does it impact your insurance. There are a couple reasons in Ontario where an officer can pull you over without cause.

Those can be:

(a) To check your driving related documentation.
(b) inspect the mechanical fitness of your vehicle and/or
(c) to check your sobriety

A sobriety check would, best case scenario, require you to roll down your window.

I'd recommend doing whatever you're comfortable with. If you want to request an early resolution, you can do that. If you don't like what you hear, you still have an opportunity to request a trial. You can also request a trial and hope for some lucky break along the way. Note, you'll also go through the early resolution process when you appear for your trial.
