VICTORY! Guys we won!!! We beat both the Speeding & Stunt Driving charges got them both 'stayed' - in order to say thanks and contribute back to these forums for all the help we were given, i've posted this thread http://www.ontariohighwaytrafficact.com/topic3722.html explaining the entire process and how we were able to win. Thank-you all so very much and thanks for these amazing forums! Radar Identified, thanks for your post and I take your point with respect to being held pending a bail hearing however we are comparing apples to oranges. With a murder or criminal trial there is an elevated risk of flight so I can understand a person being detained under that scenario, however in this particular case there is no real risk of flight. Suspending a persons licence does not mean they cant or wont drive even if you do impound the vehicle so why have it guilty until proven innocent? Something that has tweaked my interest and puzzled me ever since registering on this website and with the bombardment of advertisements on the TV, Radio, Internet etc for companies willing to help you beat your Traffic tickets - a common thread I've noticed is most of these companies are run by, or staffed by former police officers. Simon Borys thanks very much for that link to the article you wrote on your site, I read it in its entirety and found it very helpful. Thanks also to your points 1-5 above. I'd like to respond to a couple if I may. 1) As I see it, and I am sure a great many other Canadians do, a road side suspension with out a trial is infact a direct violation of Section 11 (d) of the Charter. I belive this is what the Ministry was referring to as "Police Privilege" - but there is a way to get it removed I am just not sure how and thats what I am hoping someone here can help and shed some light on. Hopefully someone knows the answer to this.

11B Victory, How To Remove Record From Drivers Abstract?

Hey guys, as you can see we've used all the advise and recommendations from this site to win the traffic tickets for my father-in-law with a successful 11B application which had the case against him 'stayed'. We are now facing a new challenge. Though his trial is now over and the 11B application has done its job - there is still a record of the Speeding and Stunt Driving offence on his Drivers Abstract and his insurance has subsequently gone thru the roof. He contacted his insurance company who informed him that his rates have gone up because there is a record of Stunt Driving and Speeding on ...

We did get the disclosure - but they sent it to us only 3 days before our initial trial date (gave us just 3 days to prepare) - then they couldn't keep the trial date because the court was too busy and they gave a new trial date at the end of April. Since we cant find out if the 11B is going to be accepted until the date of the trial, he is unsure if he wants to defend himself or seek professional help - he would like to know if the 11B is accepted before spending money on a lawyer should he choose that path. He does not have alot of money at all, hes by no means rich and money is hard for him...

Thank-you this is all excellent advise - much appreciated :)

We would only be asking for an adjournment "if" the 11B is rejected....... if the 11B is accepted we win......... so the only reason we would ask for an adjournment is if the 11B is declined. The basis for the adjournment request would be that we were counting on the 11B to resolve the issue, and since it has not we need time to prepare for trial.

This sounds reasonable to me - what do you think?

Excellent thanks thats the clarification i've been looking for. So everything that was done up until now is so that the 11B venu is available on the day of the trial - but the 11B on its own wont win the case, we need to "sell" it to the JP to win - got it thanks - and thanks for the tips!

PS: As a plan B - if the 11B is rejected, can we ask the court to postpone the trial for 60 days to allow time to consult with counsel and prepare for our defense on the grounds that we believed the 11B would be more than enough to stay the case? Would that be a reasonable request to the court?

To keep this thread updated, I will post the answers to my own questions in the hopes that it can help someone else. Here are the answers to questions 1 thru 4 (I found out that in my last post the order of who to serve first was wrong for questions 3 & 4 - below is the proper order). The offices that must be served (in proper order) are: 1) Department of Justice (Attorney General of Canada) - from reading you can serve this office by Fax, but we served them one of the books we created since they were already printed. Hi Carol Whats been done is the following. 6 Books containing all the necessary information were created and bound per the instructions on this site and ticketcombat.com. All 6 books were stamped and served to the Attorney General of Ontario and Canada. Also served was the court and the prosecutor leaving 2 copies left over for the day of court. The prosecutor said there was no need to have anything sworn, that having the books stamped and serving everyone was sufficient for an 11B application. Is this not true? Yes congratulations!!!!! I am in the same boat right now too.....

Question for you guys - I too have gone thru the 11B process but want a Plan B just as diehard, lets say your 11B is hypothetically is rejected - can you then ask the court to delay proceedings for say 30 to 60 days on the grounds that you have not had enough time to prepare your case or consult an attorney due to the fact that you had an 11B pending?

Would the court accept this and provide you the requested time to prepare for trial?
