Re: Electronic Proof of Insurance Cards - accepted by LEOs?
Sorry for the naive question, but what legislation would have to be changed to allow electronic cards? The Ontario Highway Traffic Act? Compulsory Automobile Insurance Act? Some other Act? The plain language understanding of the CAIA is that Ontario's FSCO Superintendent has the authority to specif...

Re: Tint law on new vehicles
As usual Decatur nailed it ;) But OPS are heavy into S.73(3) charges and are definitely using the new safety standards to back it up. It's not a roadside enforcement so much as an objective basis to use as a ground for the charge if challenged in Court. Ottawa Courts are notorious for not entertaini...

Re: got pulled over on a bridge bus lane in Ottawa
OP: S.182(2) is simply the Disobey Sign charge, same penalty, 2 demerit points. As for the NCCTPR, the official Act is found here . All S.4(1) says is the Regs allow enforcement of any Provincial or Municipal traffic regulation by proxy. I won't say your chances are slim, but from my personal experi...

Re: Prohibited Turn Sign Cannot be Seen
JP means Justice of the Peace; in most POA Courts, JP preside, not Judges. So you won't really talk with the JP per se. You will show up to Court, may or may not speak with Crown prosecutor before hand, then if you go to trial you will enter a plea, the Crown lays out the case, Officer testifies, yo...

Re: got pulled over on a bridge bus lane in Ottawa
I just want to clarify something: you were charged by Ottawa Police or RCMP? Thing is Portage Bridge is an NCC bridge that falls under the NCCTPR, not the HTA. OPS usually don't bother but RCMP will charge under the NCCTPR. As such you should have been charged under S.4(1) pursuant to the HTA S.154....

Re: Prohibited Turn Sign Cannot be Seen
A sign prescribed by this Regulation, other than a sign prescribed by section 13, 14, 15, 24, 25, 26 or 27, shall be so placed as to be visible at all times for a distance of at least 60 metres to the traffic approaching the sign. You are correct, my apologies I misunderstood what you meant and to ...

Re: Warn Range under 22
I agree that you should/could have gotten a fine for Young Driver with alcohol. For fines/fees/convictions that's not how it works: not having been charged only means you didn't get the $110 fine for Young Drivers. Reinstatement is independent from a charge, and you will have to pay the fee for sure...

Re: Prohibited Turn Sign Cannot be Seen
Hi! Ok so a few things: disclosure is sent from Crown to you. You are not required to disclose anything to Crown prior to trial unless you want to, as is your right. Of course you may disclose your defense to Crown in a pre-screen meeting in hopes they will agree with you and either pull the charge ...
