Thanks for the recommendation. Btw, did he fight your ticket for you in court?

Anyone else?

Good paralegal in Niagara Region?

Hey,

I got a speeding ticket in Niagara Region on my way to the Falls. Can someone recommend me a good paralegal that will fight my ticket? As I am located in Markham, I cannot make it to Niagara to fight my ticket.

I asked Redline (charged.ca), they do not do Niagara.

Thanks

Re: Visual estimation of speed from the side, inaccurate?

30KM/H through a controlled intersection would be grounds for dangerous driving, IMHO.

Actually, can I use this in my defense. Arguing that if I did drive at 30kh/hr through a controlled intersection would be grounds for dangerous driving and the officer should have also given me a ticket for dangerous driving, which he did not, therefore I was ...

Re: Visual estimation of speed from the side, inaccurate?

In this case the speed means jack. You will have to prove that the officer's vision of your wheels was obscured by another car when you came to a full and complete stop.

I understand what you are saying.
But, any way to prove that 30km/hr is not an accurate estimation, as 30kh/hr sounds alot and I just want to create doubt that the estimation is ...

Re: Visual estimation of speed from the side, inaccurate?

I've had lots of success with this...giving a side view speed estimate is a little harder to be accurate to within 5 km/h let's say, but there's a huge difference between 0 and 30 km/h.

Was he watching your wheels under the other vehicle's?

Was there noticeable acceleration / deceleration viewed by the officer?

I'm thinking the officer won't ...

Visual estimation of speed from the side, inaccurate?

I got a Failing to Stop 136 (1)(A) ticket, in the officer's notes it says I "slowed to Approx 30km/h."

In fact, I did stop as the officer's view was obstructed by another vehicle adjacent to him. Also he was perpendicular to me, I was driving Southbound and he was driving Eastbound at the intersection. From my research, when speed is visual ...

Do courts provide illustration materials?

Do the courts provide a big presentation pad and marker or a marker and board or any sort of device that I can use during my defense to illustrate to the Justice about my traffic violation?
Specifically at the York Region Court on 50 High Tech Road in Richmond Hill?

If anybody wants to know, go to the office where you ask for a trial date.
For me it was 50 High Tech Road in Richmond Hill.

How to find if officer filed ticket on time?

I was just reading ticket combat's website and noticed that if the filing date is beyond seven days it is a fatal error, http://www.ticketcombat.com/offences/fatal.php

How do I go about to find out when my ticket was filed?
Btw, my offence happened in York Region and Provincial Offences Office is at 50 High Tech Road.

Thanks

Re: Attaching case laws in Form 4F appendix

Alright, I have decided to just include the overview of the case laws as provided in the Canlii in my Form 4F appendix, is that a good idea?

Just going to include in:

R. v. Stinchcombe, [1991] 3 S.C.R. 326 http://www.canlii.org/en/ca/scc/doc/1991/1991canlii45/1991canlii45.pdf Pages 1-3 only

Attaching case laws in Form 4F appendix

I am gonna file for a stay by filing Form 4F. Since I was not provided proper/full disclosure.

Since I referred to case laws R. v. Stinchcombe and R. v. O'Connor each being 27 pages and 140 pages respectively. Am I suppose to attach the whole case file in my appendix of Form 4F or just part of it? If just part of it then which part?

I am going to ...

Re: Question regarding a representative in court?

You can always represent yourself in court. A friend can help you but you cannot pay them or give them ANYTHING for the help.

The ticket you were issued is invalid. Read the ticket, option 1. It tells you that in order to settle out of court you must pay the total payable.

Section 8 of the POA only requires you to pay the set fine amount ...

Question regarding a representative in court?

I got a failing to stop at a stop sign, 136(1)(a).
I am going to request a trial in a couple of days, but want to know that do I need to inform the courts now that I might have a representative to fight for me instead or I can bring in a representative to fight for me at the time of the trial? If I do not fill out anything under "Representative's ...
