I'm not surprised actually this is happening given that things like this are becoming quite common. It seems freedom is dying in general in Canada.

Charter violations by the Ontario government
So the Ontario government wants to end trials for traffic ticket offences(not only parking as before).
Here is the proposed consultation. You can find a pdf outlining their proposal.

Clearly this is a Charter violation. Pls email then and say no to this outrage!
Why not just end trials for ALL offences. Let the police jail, who they want, that's the most efficient.

You can't lose by filing for trial. File for trial and wait. Firstly you delay the charge entering your record until potentially you are 25(when insurance rates drop). Secondly, you may never get a trial(sometimes they make mistakes and mess up something)-this is unlikely however. If it comes to a trial date, you can always ask for disclosure and if something is missing you can get the charges dismissed(again unlikely as police are generally pretty diligent). However, if the trial date is over 10-12 months you can get the charges stayed on the Charter section 11(b). Also the police officer may...

Alberta Photoradar Ticket for ON Plates
I received an Alberta photoradar ticket. The car has Ontario plates. I'm wondering what would happen if this ticket is not paid. I did not drive or speed in this vehicle and hence I do not intend to pay this fine.

This probably warrants a complaint to the law society regarding the paralegal's conduct. The prosecutor, who is an officer of the court, also acted improperly and should also be the subject of a complaint. Next time, at the trial you should ask the judge prior to the trial for the paralegal and the presecutor to testity under oath about what happened. If you can elicit what you said happened, the charges should be dismissed due to presecutorial misconduct. Moreover, this may be a case of obstruction of justice under The Criminal Code and something that should and hopefully will be investigated...

How is this even constitutional when the Canadian Charter of Rights and Freedoms clearly states in Section 11(d):
"Any person charged with an offence has the right to be presumed innocent until proven guilty according to law in a FAIR and public hearing by an INDEPENDENT and IMPARTIAL tribunal"
Somehow I don't think an employee appointed and accountable to the City is fair, independent and impartial.

http://fightyourtickets.ca/mississauga-parking-tickets-can-no-longer-be-challenged-in-court/ As the above link says, Mississauga is moving parking ticket disputes out of court to be "adjudicated" by city employees. Essentially instead of having one's day in court before an impartial justice, the city becomes judge, jury and executioner. How is this fair? What does one have to do to appeal this and get it oveturned(appeal to the SCC?). Hey All,
I have a question. I was driving recently and was caught and charged under the distracted driving law as someone called me. It mentions I have 15 days to pay but I want to consider my options. I also read in the newspaper that the set fine of $155 will be going up March 18th.
Would this apply to me if I pay after March 18 or only to those caught after this date? Thanks a lot everyone for your reply.

Hey Everyone, Appreciate your help. I was caught going 42 over. The ticket was reduced by the officer to 32 over. Of course disclosure wasn't provided. During the first court session(about 5 months following offence), the prosecutor argued that it was my fault that disclosure wasn't provided and wanted me to read the officers notes there and then. The judge disagreed and adjourned the trial, but she said it was my fault I didnt want the trial to go on. Hence any 11b motion, she would not grant(He said this even though I did not mention anything about a 11b motion, which shows clear evidence of...
