Yes its possible they can do that.

But remember you can tell prosecutor you want to plead not guilty and then when the trial starts they will say one of two things...
(1) we are not ready to proceed (officer is not there) and are withdrawing the charge, OR
(2) we are ready to proceed (means officer is there).

If (2) happens then you can just say ...

I can't find my cop. But the prosecutor said cop will show up if they call him. Is that true?

Court start at 9:30. If I plea not guilty, my case will be handled very late, and cop might show up at 2pm, is that ture?

I did plea guilty, I'm afraid to bet.

You should advise the Prosecutor and the Provincial Offences office that you will have video evidence that you want to present and that you require XYZ to play it.

Then when you show up, you can expect that they will most likely NOT have anything for you to play your video on.

They may want to keep the video you bring as evidence, so the best ...

I received a speeding ticket* about an hour ago, but only now realized the unusual situation and don't know if the below is usable in court.

I am having a bit of a hard time recalling exactly how much I passed the line by, however my worst-case estimate puts the rear tire around the white line (either slightly before or slightly past it). My car was not sticking out far enough to impede any traffic in the intersection, and I think pedestrians had some room to cross without stepping ...

I am stopped at a green light, waiting for the car in front of me to complete a left turn (I was going straight through). The car in front of me makes his turn and I start to move. What if cop shows up but witnesses don't

From the disclosure I have got, the prosecutor summons the cop and 2 witnesses to the trial.

i'm sure cop will show up because he gets paid.

But what if both witnesses don't show up? Do I win the case almost 100%? Is the email witnesses wrote to the cop served as evidence in court?

thanks for the reply.

by conviction I meant the 2pts record on my driver
abstract.

I called MTO today and the record is still there.
the agent said the record will not be removed until I win, yet he might be wrong.

THE CONVICTION REMAINS ON YOUR ABSTRACT UNTIL EITHER A REOPENING OR APPEAL IS SUCCESSFUL


My question here:

the conviction will be quashed when the reopening is granted or when I win the reopened trial?

Just a follow-up:

I did reopen my case since I did NOT receive the ticket from police (nor any trial). Instead, appealing will take me to next level court and reopen will hold a trial in the provincial court.

The trial notice will come faster (6 weeks or so) because this is a reopening trial.

The reopening is granted on Jan 25th.

I kinda screw up due to police's fault. My driver record was clean before I "was forced" to be convicted for a "unsafe turn" ticket. And I need to spend more time to deal with court and MTO.
