Thank you for your response and help. I assume there is less chance I can ask for a trial, ask for disclosure (hope there are some procedural issues) but if there isnt, pay the current (amended lower) ticket/fine, etc at my trial date? Or is it more likely that the minute I show up for a trial, they will likely amend the ticket up immediately and have no option for this amount? I assume this happens often as a punishment for trying to fight it? I don't mind spending a bit of time to see if I can the ticket thrown out first before paying, as long as I can pay the current (lower) amount. Can I s...

Hello All, Today I was driving in a 60 zone that suddenly dropped down to a 40. I did not realize and was keeping up with traffic in the area. I was pulled over by a police officer who was radar'ing from a hidden location off the side of the road. He informed me that I was driving 72 in a 40 zone. After giving me a ticket, he explained he would bump it down to 69 in a 40 zone in order to reduce to 3 points. UPDATE: Hello All, My girlfriend went to court today (for the second time) with the plan to provide proof that she did have a valid sticker a the time of the ticket and would want that charge dropped, if she plead guilty to the other charge. She arrived at the court and found on the docket her case info crossed off and said "ADJ". She was confused by what to do, if they are going to make her come back for a third time? How much more are you expecting out of a disclosure request for parking tickets? What exactly are you looking for? Thanks for the reply. Our initial hope was that the time to trial would be unreasonable or to not receive disclosure so that the charges would be stayed. Unfortunately, this did not happen. The "notes" provided are essentially worthless and provides her no details as to what the officer will say in a trial. So, can we assume that this officer is just going to repeat the information from the ticket with no other details? Will these 4F and 4R be somehow relevant but we do...

Hello All, Some backstory: In July, my girlfriend had received 2 tickets for parking on a Toronto street. One ticket was for parking after midnight without a permit. She had gone into the home she was visiting to look online to buy a permit but was ticketed before this could be achieved. The other was for not having a valid plate because she had one of the defective plates where the upper "sticker" with the colour falls off. Hello Everybody,
My friend received the notice of impending conviction today and she noticed on the form it says "Warning: on conviction you will be required to pay the set fine plus the court costs of 16.00 dollars".
Is this only if she does not respond as a penalty? Or is this if she fights the ticket in any fashion? Meaning, if she requests a trial date and loses, she will be penalized for it? Is this new?

Parking Permit Grace Periods
Hello All, Someone I know was staying at a family member's home for the evening and received a "parking without a permit" ticket for parking after midnight on a Toronto street. She arrived around midnight and parked her car to go inside and look online to purchase a permit for the evening. She went back to her car to get some information and found a ticket already on her window. Is there a generally accepted "grace period" for someone to have the time to purchase the required permit? After some of the comments on here, I was planning on ignoring the charter question and wait for another trial. When I met with the crown, he opens the file and right on top is my charter challenge paperwork.. My heart dropped. Hello All, Sorry for re-replying to this old thread. I have still not received any disclosure from the prosecution. My trial will be coming up shortly and just want a definitive answer to a couple questions. 1) Should I ignore my attempt for a stay based on lack of disclosure? IMO you wasted your time and money filing the stay for non-disclosure. This is disappointing but thank you for your input. I would not have put so much time and effort into fighting this if the courthouse wasn't 5 minutes from where I live. Filing papers and whatnot could be done without any real hardship to my time. What I am looking to do is explain to the court that I was expecting to defend myself to the charges against me and I followed all proper procedures and timelines that it seems is part of the trial process. Hey All, Today I submitted my notice for constitutional question to the prosecution and the court since I have not received any disclosure and my trial is roughly 16 business days away. I was pretty nervous when the clerk at the prosecution office found out what I was submitting and told me to hang on as she walked away to speak with someone. I was sure she would come back saying that they will provide me with my disclosure right now. I didn't know how I would react to this? Take it? leave it and say "too late"?... Ticketcombat is an excellent resource and starting point, but dont take it as gospel. Posters on this forum have reported mixed results arguing the requirement to provide a bylaw for signs. The Crown will typically argue the sign itself is evidence of the bylaw. Unfortunately I dont know what case law says on this point. Be prepared to argue why the sign itself shouldnt be considered sufficient evidence for the Court. It also might not hurt for you to do some research and see if a bylaw actually exists for the sign.
