Do I need to disclose evidence in advance?
So I believe that the officer indicated in his notes that he used a different gun than the one he actually used to measure my speed. If I want to bring an image of the gun that looks like the one he said he used and an image of the gun I think he used, do I need to disclose that to the prosecutor in advance of the trial or only if the prosecutor asks me for disclosure? Also would it be advisable to alter the images to hide the names of the manufacturers of each gun?

I find it despicable that you're trying to turn an officer's loss into an advantage for yourself after being caught for (probably) breaking the law. First of all, I am not trying to turn the officer's loss into my advantage. My ticket went to trial remarkably quickly. I got it in March 2011 so to have the trial in July seems fast to me at least compared to Toronto. So even with this new delay I doubt I'll be able to file an 11b so I don't see how I gain from this. Frankly since I'm not a lawyer I have to spend quite a few hours preparing for trial each time before I go to court so any delay e...

So I went to trial today to contest my speeding ticket ready to argue improper disclosure by the prosecution but when I got there I saw the row of cops sitting down on the bench but didn't see mine. One of them asked who I was looking for I told them the cops name and they replied that he hadn't arrived yet. I then asked the prosecutor if I could speak to the cop but the prosecutor wouldn't let me. In court the prosecutor pulled me outside and told me that the cop had a death in the family. I went to the first appearance today, the prosecutor didn't even know I was coming since I wasn't on some list or other. He offered me failure to obey sign a 2 point offense. I rejected the plea since he couldn't offer me a non-moving violation. You guys were right about that, so I think my best bet is a trial since I doubt I'd get a worse deal prior to trial, and the chance that the officer might not show up or I could get the case kicked due to improper disclosure, or unreasonable delay. I guess we'll see.

Hmm ok well I guess I'll see what happens tomorrow. Does anyone know how long it takes in Ottawa for traffic court cases to go to trial? I'm also guessing that if I turn down whatever plea the prosecutor makes me at the first appearance and request a trial I could still accept the prosecutor's offer later or they likely would offer another plea on the date of the trial.

Thanks for the information Stanton, in regard to your question as to what plea I'm seeking my understanding from the ticketcombat website was that if you could get the prosecutor to plea down to a non-moving violation ie. not a Highway Traffic Act violation then your insurance provider wouldn't find out about it. So back on March 18 2012, I was given a ticket for "Speeding - 101 KPH in a 70 KPH Zone." The officer was waiting just off Bronson Ave. in Ottawa on a side street (Brewer Way). I was in the center lane and had just passed a silver car that was in the left lane. I slowed down but the cop pulled me over just before Sunnyside Ave. at 10:54 pm. He then gave me a ticket and made an illegal U turn at Sunnyside Ave., which has no less than 2 no u-turn signs (presumably to return to Brewer Way to give more drivers tickets).
