Re: They gave me two days to make a decision
Arguing you went through the red light because of car trouble will not go over well in Court. Red light offences are what are known as absolute liability offences, which basically means there is no excuse, short of your life being in imminent danger (i.e. mad gunman chasing you). Weather and/or car...

Re: They gave me two days to make a decision
I have a decent explanation with proof. Do you have a defense or an excuse? Excuses aren't going to take you far in a trial. Keep that in mind when preparing a defense. Red light camera tickets aren't going to impact your insurance, which is why many here don't really worry about them. They don't k...

They gave me two days to make a decision
So i just received my red light ticket in the mail. It has to be serviced in two days (well less than that if we are counting hours). August 22nd 2013 I have to service the notice. The envelope is date stamped on the 15th of august, 2013, and was in the postal system for about five days. The origina...

Re: Notice of Abandonment of appeal (Clerk of the court)
thanks for the help stanton.
Is there any downside in going to an appeal hearing and not winning?
For example, If I were to go to an appeal hearing, and the charges were not dropped, would the charge reset to year 0 regarding insurance and demerit points?

Re: Notice of Abandonment of appeal (Clerk of the court)
So I was told I have to pick my transcripts up. I have until Feb 3rd to present these, however the original conviction was back in 2007/2008 The prosecutor said that its no longer on my record and I should just forget it. If I abandon at this point, is the above true (where nothing will return on my...

Re: Notice of Abandonment of appeal (Clerk of the court)
After an amount of time, if there is no response from you, the courts "assume" you are abandoning the appeal. If you wish to continue the appeal, then go to the hearing and state why you are. If it's a matter of missing correspondance then this will be srted out. This is one of the "...

Notice of Abandonment of appeal (Clerk of the court)
Hey i'm not sure whats happening. A while back (like 2 years) I was charged in court with speeding. I had appealed this charge and was awaiting a trial date. Fast forward like two or more years, and I just received a letter in the mail saying "Notice of abandonment of appeal (clerk of the court...

Re: So this is what happend in court today
Thanks for the information Radar Identified. If I can't read the disclosure of the officers notes, I'm going to have to ask for another copy typed by the prosecutor. If this is the case, can I just fill out a "stay of proceedings" at this point? I have been back and fourth to the courthous...

Re: So this is what happend in court today
Thanks for the reply joepenoso,
The new date isn't until march 2012.
Can I Still apply for the "Stay", even though it's been ajourned, or will i be better off trying the 11b?
Thanks

So this is what happend in court today
I didn't recieve my disclosure in time, and I asked the JP to have the charges "stayed". (Yes the prosecutor screwed this one up and never gave me the my proper disclosure). They suddenly offered me an ajournment, and now I have a new court date. Could I have gotten off if I was a little m...
