Red Light Cameras - Mississauga
I'm starting to lose confidence in my driving skills... I'm currently in the midst of awaiting trail for "Improper Passing of Streetcar" in Toronto, last year. And now this happens!! :x On my drive to work today, I entered an intersection after the light turned Amber. It then turned Red while I was in the intersection. A moment later I saw a flash of light behind me... and noticed the traffic camera posted at the intersection (the ONLY one on my route, and I ran it!!!). Hmm... wait, what are you saying? That I shouldn't mention the TTC driver? It's unavoidable, as the cop mentioned the sound of the horn. However, on the ticket he issued me, it says "no witnesses". So the streetcar driver should be present. Does this mean I'd have to adjourn again? I HOPE NOT.. I'd rather end it there. It would depend on the judge I guess.

I'm outside s/c. When I hear report of s/c horn sounding I turn to see s/c @ TTC stop doors open, stopped & grey mazda passes open doors slowly. I run across Gerrard & stop vehicle tell vehicle to go to Blackburn St. (Also included is a little drawing of where he was standing relative to where my car was. This apprears accurate.) From this, I guess I have 2 points to argue in my defence: * While his evidence states that I passed the open doors, I can still argue that he admitted that he had to turn to see what was going on. Trial Update!!! ADJOURNMENT GRANTED!
WOW - that was quite an experience. The cop was actually present!! So I'm glad I was advised to assume he'd be there. :) At the desk outside the courtroom, the prosecutor asked me what I was going to do about the charge. And I said, "not guilty".. then she proceeded to ask what I would say. And I went ahead and told her I had requested disclosure but did not receive it. (I KNOW YOU GUYS HAD SAID NOT TO TALK TO THE PROSECUTOR ABOUT WHAT MY PLAN OF ACTION WAS GOING TO BE, BUT SHE ASKED ME DIRECTLY.. AND THAT'S WHAT THE OTHERS DID TOO!) If the judge grants me an adjournment, what is the next step I take? Do I find out my next court date immediately, or should I go to the office there and line-up to request a new date (like I did for my original Court Date)?
Just asking... in case I excitedly walk outta there without doing something I should have done.

Another question...
What if the prosecutor gives me the "disclosure evidence" when I meet him/her just before the trial? Can I still say that I need an adjournment to review the evidence just handed to me? Or will the judge say I had plenty of time to review it in the hallway while awaiting the trial?

Ok, so let me see if I got this right. Here is my action plan. (Sorry I had to break it down like this, but I'm really nervous about this..it being my 1st time appearing in court.. so I don't want to screw up! I'll likely carry this list with me!) :o 1. Ask prosecutor if cop is present. If not - case dismissed. If he is present.... 2. Ask prosecutor (or judge?) for adjournment because disclosure was requested on June 15th, but was not received. If adjournment is granted, go home. :) If not granted....DO NOT ACCEPT PLEA BARGAIN. 3. Describe to judge about how the cop was radaring the other side...
