So I got convicted of a dui.. I have been riding my bike in the snow and taking the bus. I am a driving enthusiast and I will be going to the race track all summer but I NEED to drive something right now! Make sure you think this one through carefully. The prosecutor in Sarnia will seek to amend the ticket back to the 35 over and I have yet to see a JP here deny that. Sounds like it was OPP on the 402 and I know that they have a new Inspector that does not take too kindly if they mis POA court. So you can count on both officers being there.

If you read that it says you do not impound the vehicle for 7 days as part of the hta VIP. No where does it state that the officer can not tow the vehicle to have it removed fom the side of the road.

How would they have evidence that it is you driving? anyone could be driving the car, same goes for parking tickets, it just gets sent(or billed) to the owner. If they have no reasonable evidence (ie. photos) I'd say anyone could have a good defence. For example, lets say the bus driver wrote down the license plate. The next day the cops want to hand the ticket to the driver of the car, so they visit the address. Can they give the ticket to the owner and give him the demerit points? 175(11) instead of 175(19) In this situation it would be an owner offence because they wouldn't be able to prov...

First off, you do not have to be stationary to measure speed. There are moving radar units. Second, take pictures and prove that the road you were travelling n was indeed a 70km. Because then you did not commit the offence on the ticket.

As far as putting 86 km on the ticket, as part of his evidence on the back of the ticket he would put the true speed he measured. This will likely be indicated on your ticket. Look for the box titled code, there will likely be an "r" for reduced.

If you fix it, it will likely assist you when addressed by the JP. Points will not be added as they are an MTO thing not a court matter.
The biggest this is since there is no set fine on the pt 3 it is the JPs discretion.

I know in our city if your sticker is more then 3 month expired its falls under the dilapidated veh bylaws and can be towed.

The certificate of offence is the original. The ticket is a certificate of offence, with a few carbon copies. The yellow(blue) copy that you receive is called the offence notice it is your copy of the certificate of offence.
So, you have an exact copy already. Minus the evidence on the back which you receive when requesting disclosure.

The certificate of offence is the ticket that the officer fills out n files with the court. The notice of offence is your yellow (now blue) copy.
So certificate is courts copy notice is your copy

You said you switched lanes to the right to pass, were the vehicles stopped for the bus and you went around? You would be wise to consult legal advice maybe take a plea or plead guilty with explanation.

154.1 (a) of the HTA states that the driver shall not move from the lane until the driver ascertains that the move can be made in safety. In this particular case it doesn't sound like it was safe to do so.
In regards to the fences as long as it's the farmers property and he isn't on any right of ways I don't see why he can't fence in his own property. If you are going to argue off of that you should be able to find and quote a law.
Did you speak to any of the witnesses? Did anyone see this car fly by? Can you get statements to that fact?
