The policemen did not charge you yet. So, nothing you can do right now. And I am not very sure about this, but HTA does not apply to private property. For the insurance company, if the other party have already reported to their provider and your insurance company will know for sure because other party at least had your plate number. Otherwise how the policeman found you. The insurance company can track the number and find you and contact your insurance provider. And your insurance company will contact you and hear your side of story and make the decision about the responsibility. And I do not ...

This is simply a 3 day suspension (Provincial) for being in the "warn" range which is 50 to 99mgs of alcohol in 100ml of blood.
(Which is minimum 4 drinks still in the body at time of stop)
The offence the OP got was for being a "novice driver with BAC above zero" plus an administrative 3 day suspension for the alcohol level.

And DUI -drive under influence is not a traffic offence, it is criminal offence which is much much worse than careless drive.
So, get some money and find a good lawyer.

I think all the conviction stay on your record forever no matter you get your G license later or not. And those conviction will affect your insurance rate for certain time period.
Even you get your G license, those conviction will still affect your insurance rate a lot. And honestly, it is not easy for you to get an insurance base on what you be charged . Even you can get one, the price will be sky high.
You can always hire a lawyer or paralegal to help you. How much they can help depends on your case.
I really think you should get professional help for your case.

I think there are two different issue. No matter what the officer did, you still break the law. The ticket is for your wrong action.
For the officer, maybe you can file a complain about his beheaver.

I believe incorrect location is not fatal error.

If you request disclosure on the trial date there would likely be an adjournment to allow for you to receive disclosure, but I don't think the JP would be happy that you waited until then.
In my case, the crown did bring the disclosure to the court even she did not receive my request. And after I shower her the fax receipt, she asked the JP for adjournment. And that day, I think she bring all the disclosure to the court.

I got my disclosure on my first court date. But in fact the crown never receive my fax request. So I think, now days, the crown do prepare the disclosure for every case

Here is my story, My first court date was Oct. and before that date, I faxed twice for my disclosure and never got one. One my first court date, I showed the prove to the prosecutor and she asked adjournment for another date which was really important. Because the fault is on her side. On my second court date, the witness did not show up. But the crown found out that the witness showed up the wrong time and she wanted another adjournment to get the witness showed up. And I argured that It was not my fault that the witness did not show up. And the PJ said, she would give both side the chance to...

HI
I got my court notice in middle of the July. And I faxed my request disclosure to Prosecutor's Offices on July 19th 2011(I did not give them my phone number only my address). But until today, I got nothing from them. And my court date is on middle of Oct.
So my question is, Should I fax the request again or should I go to the office by person?
If I can not get my disclosure when the court date arrive, is that any chance, the prosecutor will withdraw the case?
