Are cops encouraged to use private properties to sit and watch from in their cars, for example in gas stations, fast food restaurant parking lots, etc...
Or should they not use private properties without permission. According to their policies should they conduct HTA scouting from city properties only ?
Just curious because you really see cops stuffed into any nook these days awaiting their prey, with radar traps etc...
Local business customers may avoid their business for fear something may be found wrong with their driving or vehicle.

I don't think the JP will be harsh on you sentence wise if this is a first offence. My opinion is to state your case yourself, state the truth, and that you are in hard times. Tell him/her you took care of it immediately and bring proof, and show remorse. The money you will spend on hired help, use it towards your fine. JMHO

Just curious if it is legal to video tape or audio tape your traffic stop interaction after you have come to a full stop with engine off in full view of the officer.

1) Contact your insurance provider. Two minor convictions will likely have a minimal insurance rate increase, but it varies from one provider to the next. 2) Court cases must take place in the jurisdiction where the offense occurred. So no you can't have it in Toronto unfortunately. 3) Probably the best you can do is a reduced fine. There really isn't a less serious offence. Make a court date and hope it is farther than the 11 months, if it is file an 11(b). Don't alert your insurance company to the fact you got a ticket, my opinion. Cop may not show up for court, ticket gets dismissed. Not a...

What the JP would have been referring to was on trial date. How ridiculous would it be if disclosure is sent to everyone that gets a ticket even if they don't ask for it. If you are at trial and haven't got it, im sure the prosecutor would just hand you a copy then you're stuck deciding what to do. You can ask for an adjournment, but its no guarantee. The prosecutor would just say that you knew about the trial date months in advance and never asked for it. Depending on court houses, they have a disclosure pick up bin. It could be in there. Years back, I went to trial and questioned the officer about the events and the statements he had made to the court. I won the case because the officer's notes were NOT admissible BECAUSE he neglected to not down the ENTIRE conversation we had for the most part. The JP noted the officer agreed to some conversation we had THAT WERE NOT WRITTEN IN HIS NOTES. The JP said that the notes are not admissible because the ENTIRE conversation was not archived, that the officer CANNOT pick and choose what he wants to note down. Interesting I thought .... When one gets a ticket and at the time of the ticket, the COP had video taped the interaction, can the COP delete the video legally even though it holds evidentuary value should it go to trial ?

I remember being in court years ago and a guy representing the defendant pointed out to the JP that he didn't receive disclosure. He argued where does it state that the defendant NEEDS TO ASK FOR DISCLOSURE . The JP replied, "... yes, I know the prosecutor needs to provide it to you and you don't have to ask for " I was next and didn't know about disclosure, so I repeated the same thing, and the COP had to again go out to copy his notes. Cop wasn't too pleased needless to say. So I guess for anyone that knows, can one simply not ask for DISCLOSURE and on trial date, claim DISCLOSURE ...

A cop that stopped me said I was being video and audio recorded.
Will the cop keep that video so I can ask for a copy of it in disclosure?
