I find it a risky approach. The prosecutor could have easily tricked you. He might have said that he would withdraw the charge and in front of JP he would have amended the ticket and forced you to go to trial.
I think the prosecutor was honest by telling you that he is not withdrawing your charge and he may have underestimated your research.

I would think these arguements and the citation of a case law does make sense however I don't have much experience dealing with courts.

Quick question -
While requesting a witness interview and witness criminal check, do I need to mention the reasons in a disclosure request to the prosecutor? OR I just need to provide the reasons to the Justice of Peace when the prosecutor doesn't provide the witness interview and criminal check.

My first court date was in June and it was adjourned as the prosecutor had failed to give me full disclosure. The second court date is in August. I got a call from the prosecutor yesterday and he asked me to pick up the disclosure from his office.

1 - I guess I should be more specific. My question is does the Crown has a legal obligation to find if the witness(es) have a criminal record? I don't think Crown has even checked whether the witness(es) have a criminal record or not and they are arguing it's irrelevant information.
