Re: Charge Withdrawn - Success story
, showing my calibrated speedometer and my GPS, another . I have yet to see any civilian vehicle that has stamped on it "calibrated speedometer" such as in purpose built police vehicles. Where does one go about obtaining the personal vehicle calibration? How much does it cost? I have aske...

Re: Canlii Reference's
The problem I see with Raham is it derailed the serious HTA 172 constitutionality discussion to a tussle on esoteric differences (even in legal terms) between types of offenses. A law (HTA 172) which says penalties (administrative penalties are still penalties) can be levied with no due process or t...

Re: Charge Withdrawn - Success story
Sorry to offend Radar, but it is frustrating to present common-practice concepts regarding legally required industry standards of calibration, measurement and documentation to have it all weasel-worded away. Maybe that's why Metrology is a bit of a mystery to those who deal in a relativist legal wor...

Re: Calibration discrepancy or sloppy writing - viable defen
That's funny. I don't see any mention of a "laser" being used or anything on the disclosure about "calibration" I see a Decatur Electronics Genesis II being used. That's very funny... to me all those Magic Speed Reading Boxes are the same, no matter which electronics company mad...

Re: Calibration discrepancy or sloppy writing - viable defen
At least whoever created the form got it right, calling it "comparison" not calibration. But it gets treated as a calibration, as there is no actual calibration. Sorry, no points this round. Why should the defendant have to educate the police, prosecution and court on such a basic concept?...

Re: Calibration discrepancy or sloppy writing - viable defen
Oh PLEASE! Using a speedometer to "calibrate" or even "verify" a laser unit is like using your foot to calibrate/verify a tape measure. It's even less pertinent than the self-check. OK, the speedo and the radar agree, but which one would be taken out of service if they didn't? Wi...

Re: Charge Withdrawn - Success story
This thread demonstrates how a flawed understanding of metrology can lead to all sorts of weird and wonderful results. Lets separate out the component parts. I think all now understand that the FCC/Industry Canada Certifications in the User manual have nearly nothing to do with the accuracy/precisio...

Re: Charge Withdrawn - Success story
The point of ensuring proper INDEPENDENT calibrations are done and documentation is maintained to police speed measurement devices is to remove any question on that issue. If these were always done and readily available upon request, the courts would soon blanket stipulate that unless there was conc...

Re: Breathing new life into "guilty with explanation"?
At least the idea has made it to this level of court, and given the significant consideration apparently put into this ruling, doubtful it would be overturned if applied under the appropriate circumstances. Maybe the JP's/judges are also getting tired of the ever-increasing stream of legally-enabled...

Breathing new life into "guilty with explanation"?
R. ex rel. City of Toronto v. Doroz, 2011 ONCJ 281 http://www.canlii.org/en/on/oncj/doc/2011/2011oncj281/2011oncj281.html On appeal, found that the court can give a suspended sentence on guilty plea entered for speeding charges, if the judge feels circumstances do not warrant imposition of set fine....

Re: Charge Withdrawn - Success story
? Most radar units I've dealt with are sent back to the distributor and calibrated on an annual basis or when any repairs are done. Did any of the radar/lidar units you've dealt with carry stickers showing the name of the calibration lab, the date and the inspector's stamp? Are these radar/lidar un...

Re: Charge Withdrawn - Success story
It is nice that the courts recognize the legal requirement for speed radar electronic to meet basic FCC and/or Industry Canada certifications for operation in Canada. I leave it to others to figure out whether some form of reciprocity exists in Ontario courts for FCC/IC certifications for radar/lida...

Re: (and a few other questions)noise, aftermarket equipment
The "anti-noise" situation is very fluid at the moment, with local jurisdictions like Caledon passing by-laws relating to SAE vehicle standards. In most cases, the by-laws specifically target motorcycles, but it appears the legal challenges to this narrow targeting may mean all vehicles wi...
