you should be pretty worried at this point, if prosecutor doesn't offer you a 49 over now, chances are slim to none come court date even with a paralegal
it will go to trial and the JP isn't as lenient. you are probably fooked

Re: 156km/h reduced to 149km/h on the spot in 100 km zone
Regardless reduced or not you should always put thru the trail option unless you are too rich and don't care about your insurance. The insurance hiking is not a one time thing and it takes you years to go back to the same rating group. And yes a minor is not such a big hike but still takes years to...

Re: No Insurance Card Ticket
So I just got the disclosure request.
How do I go about pleading guilty and just paying the ticket before the trial date?

Re: No Insurance Card Ticket
If there are no fatal errors, you won't have it dismissed unless you or someone acting for you is there. Has the Prosecutors office replied to your disclosure requests? If so, you know they've been received. You may succeed at having the prosecutor withdraw the charge on the basis of non-disclosure...

No Insurance Card Ticket
Hello All, I was served with a Fail to Surrender Insurance Card (S3(1) of Compulsory Auto Insurance Act). He received it within the jurisdiction of Barrie POA. The trial is scheduled for November 14 2017. I was stopped by Barrie OPP on my way back from a weekend up in Midland ON on June 28, 2017 and...

So he did end up give you the speeding ticket? Pretty sure 41 over is not a $50 fine.
In anycase, request for a trial (plead not guilty) and ask for disclosure.

Importing Car from Manitoba to Ontario, questions
Been toying around with the idea of getting an Integra Type R. It has a bit of an extensive history according to the carproof, lots of renewal, spent its life in Saskatchewan and Manitoba. It was written off for hail damage but then re-registered, I'm guessing as a salvage title. The current seller ...

Re: S3(1) Fail To Provide Insurance Card
Another question - it says for Option 2 that I can speak with the justice but it has to be done in person on a Tuesday between 9am-10:30am? Do I just call ahead and attempt to speak with the prosecutor anyway? The office is at Wasaga Beach and I won't be able to attend in person

Ok thank you jsherk.jsherk wrote:Yes you can change. Early resolution is just a first step towards trial. If you do an early resolution meeting and do not like what is offered, then you can say to prosecutor "I would like to set a trial date and get disclosure" and they will do that.

Re: S3(1) Fail To Provide Insurance Card
Prosecutor for Midland is in Barrie, so you would have to contact the Barrie Prosecutors office to find out if they can do Option 2 via phone. If you go to trial, that would take place in Penetanguishene. The ticket iteself is almost impossible to beat unless the officer does not show up for court ...

Re: Careless Charge - No Accident
The video looks like you had enough time to stop. Regardless, you can make the case that you were trying to avoid the collision which gives validity for you actions, but that will be for the judge to make an opinion of that. Careless driving is an ambiguous offense and is one of the more difficult c...

Re: Cell Phone Ticket. Need Advice
Update: Going into this, I knew what my options were. A. If the cop wasn't there, I would proceed to trial B. If the cop was there, i. Plead guilty for a lower fine ii. Ask for an adjournment because I didn't have the in car video yet that was part of the disclosure I looked at the trial list and fo...

Re: Cell Phone Ticket. Need Advice
If I show up tomorrow in court, am I able to seek further legal representation down the road if I get an adjournment granted? Or am I the only one allowed to defend my father at this point forward?
