Re: misspelled offence for failing to stop at a stop sign
I can only speak for Toronto but if someone shows up and wants to save points the Prosecutors will usually offer Improper Stop Sec 144(5)(a) or Fail to Proceed as Directed Sec 144(12). But only if the person is willing to accept responsibility right away without argument. This will knock the points ...

Re: Prosecution provides disclosure right away on the spot?
Here in Toronto it isn't overly new. The Part 1's were changed to include a carbon copy of the notes which are submitted with the ticket and both are turned into a PDF that the Prosecutors have access to. Also starting on November 5th digital tickets started where the ticket is printed off a printer...

All trailers capable of hauling cargo needs a plate. You can haul a piece of equipment such as a generator or tar pot for asphalt repairs and they will not require plates.

Re: Reduced ticket from 46 km/h over
Also if you go to trial be prepared to fight the full 106 in a 60. You already got the break at the side of the road. Don't know how the Prosecutors are in Guelph but here in Toronto you would be given a chance to plead guilty to the 29 over as is before the trial when you arrive because that's what...

Re: MTO officer did not file the ticket in court after 7 day
The officer actually has 6 months to lay the charge if they decide to go by way of a part 3, and in some cases up to 3 years depending on the charge. Also since your part 1 offence notice wasn't filed in time the officer, at his discretion can still relay the charge within the statute of limitations...

Re: Car accident with no insurance
Were you charged with Operating a Motor Vehicle Without Insurance? If you handed the insurance card over and it was accepted then this will be on the report. If there wasn't anything to peek the Officers interest then they would likely not have checked. I have only once investigated a collision wher...

Re: Speeding Defenses + 11b Q
Good luck with your case, I see you have done a lot of research for your case, not a lot of people do that. Just remember though that the officer does this for a living and when you go to trial that it is an all or nothing proposition. You could probably take a deal at 0 points with the speed you we...

Re: statute of limitations unpaid speeding ticket
There is no statute of limitations, if you are suspended for an unpaid fine the suspension is indefinite. To get your licence back you are still going to have to pay the outstanding fine and also the licence reinstatement fee. As for graduated licencing you will have to do that because you have let ...

Re: Got a ticket for Not wearing seatbelts in backseat !!!
Today I learned that wearing seatbelts are mandatory for passengers in the backseat LOL, I'm confused as to why you wouldn't wear a seatbelt in the back seat even if it wasn't mandatory??? Is it safer in the back than it is in the front some way? That just makes absolutely no sense to me at all. Al...

Re: Signing of Plate portion of the ownership
You may be leasing the vehicle, but you aren't leasing your plates. So yes you will need to sign it. The plates are yours and should have your name on the plate portion of the permit, and the leasing company's name on the vehicle portion.

Hello there, I was in Barrie Ontario at 7:58 AM i was pulled over for doing 64kms in a 40 km zone, however the officer wrote the following things and i was wondering if i can fight it or dismiss the ticket entirely. first he wrote that i was pulled over at 7:58 PM when it was actually AM second he ...

Lol, why is it they weren't paying attention? It sounds like they avoided their collision with the pedestrian. Sounds more like you weren't paying attention because you hit them! To answer your questions you probably should call your insurance company to let them know because the other persons compa...

Re: Driving 183 on the 401
Just wondering how trucks make you nervous but going 183 km/h didn't and seemed like the reasonable alternative. Trucks in Ontario are limited to 105 km/h, the flow of traffic (right or wrong) is generally 115-120 km/h. A speed that IMHO would not likely get you pulled over and would easily allow yo...

Re: Failed To Surrender Insurance
Pay the ticket and count your lucky stars that you weren't stopped by a more diligent officer. There is always a chance you could get charged later because the officer has 3 years to lay the charge but unless you gave the name of a company that you said you were insured with then they aren't likely ...

Re: Careless driving incident
Alright, thanks for the answers guys. I had one more question though, how do the cases usually work in court? Does the witness have to show up? And what happens if they don't? If the officer didn't witness the collision then yes the witness will need to be there. The prosecutor will not proceed wit...
