FYI you can't park within 9 meters of an intersection or crosswalk in Toronto. It was not even a case the Judge just do not care, they think that I am insulting them by going into court with parking ticket plus I did not want to plea guilty...Can you argue with the Judge? Unfortunately you can not sue the other driver directly for damages. Read section 263 subs (1) and (5) of the Insurance Act. I was disappointed with the small claim court judge decision yesterday. Judge ruled out - 25% driver's fault and 75% my son's fault. The explanation was simple- car driver was negligent, as he did not see any pedestrian (bike) on a sidewalk and my son was negligent as he did a very unusual maneuver ...

As for the by-law, your son was allowed to ride on the sidewalk as TO has made sidwalks distinct from highways. This should give me the opportunity to request my $500 from this traffic tickets company who misrepresented me. Ido not know if it would be worth...I mean to do it via small claim court.....
