Need Help On 136 (1)(a)
Hello all,
My brother got a ticket last late Oct for disobey stop sign a block away from our home in Stouffville. (within the municipality York Region) . It was a snowing midnight and there was snow on the road. He got pulled over right after a stop sign right turn and being told he didn't stop completely and fined for $110 and 3 demerit points. The prosecutor said they can bring it to 2 points and half the fine.
From the recollection of my brother, he said the cop may have been following him from the back for 300-400 metres closely without turning on the cruiser's headlights. It was a 50 km zone and he wasn't sure it was a cruise at all.
He didn't stop completely in front of the sign worrying someone might have rare-ended him, but he did stop beyond the sign at some point and then yield at right turn.
Now here is the problem that complicates the case:
1) My brother isn't in Canada for 10 months now. It has been adjourned once in June by my mother. I didn't aware of it until recently this matter come in my hand. The case is going to be on trial in 2 weeks and I have no disclosure. Is it too late for everything? What should I do next?
2) Should I pay the fine and settle with them? My brother isn't coming back to Canada in a years or so. Is the insurance going to increase when he come back?
3) Should I go on a trial, my brother isn't going to be present in the court room. What is the proper procedure?
4) In case of the the cop doesn't show up that day, how do I know?
5) English isn't my first language although I can understand them fine. Should I request a translator just in case?
6) and finally, what is the chance of winning and the possible strategy?
