Driving Disqualified

Does a confiction of this offence (Criminal Code) usually come with jail time ? Also, I noticed that the paper work has a box that is available to be checked to disqualify me from driving a vessel and it is not checked off. Does this mean that a boat is possible to drive if I have my pleasure craft license ?

Driving disqualified usually results in jail time. To make matters worse, usually that time will be spent in one of our overcrowded, decrepit, rat-infested provincial jails. I wouldn't operate a vessel unless I had a specific clarification from the courts that it was allowed, either.

I ended up not getting jail time when I was convicted last week. $1500 fine and 12 months additional suspension. How do I get about clarifiaction from the courts ? If I can drive a boat, I would like to have that information, as you mentioned, incase I am stopped on the water. That's only IF I can drive a boat which I think is questionable.

If you had a lawyer represent you, the lawyer should be able to tell you exactly what the conditions were. Otherwise, the other recourse is to start by calling the general information line for the court where your trial was held. It will take some time, but they'll be able to tell you who to talk to, eventually.
BTW - if the paperwork does, in fact, say you can operate a vessel (which it probably does, but I still wouldn't chance it for now) then I'd be sure to carry that document (or a photocopy of it) on me when I'm operating the vessel.

I'm pretty sure I will get the whole thing checked by the O.P.P. and get my sticker that all the saftey stuff is present at the beginning of the year. I will also talk to the local law enforcement and bring this to their attention so that there are no complications when they do check the boat later in the summer. And I will carry that paperwork as well.
