Stunt And Careless Both At Once.... Someone Help

Okay, this is a bit of a long story, but I'll try to keep it short, and if you can give me some help.. that would be great.


Last summer, I was enjoying a bike ride, and got puled over. Cop was nice, and THANKED ME for pulling over. I was not excessively speeding, or recklessly driving, but after talking to his backup that showed up minutes later, he decides to ding me with Stunt, and careless both after talking to his fellow officers!!!


This went to court after running me mad money for towing, and the traffic ticket "specialists" that I hired. I hired one guy, who was really good, but didnt tell me his involvement with partners... When they found out, they made me come to their office, and made me sign papers so the firm could handle my case with no additional charges. They told me my money was "IN TRUST" which brings me to my first question... what does that mean??? You see, I went to their office to tell them all the juicy details, and show them how the officers notes were botched, and different then his statement, they would not let me take the disclosure home, so I sat there and fired down tonnes of information. They praised me with the ease this is to them, stating that this would be an easy case cause of the information and pictures i provided. I told them i have been to court several times, and not to send a banana..... they sent an F'n BANANA!!! He shows up 5 mins before court, and opens his books to a blank sheet of paper and asks me what I should ask the police officer on cross-examination. Right away I was wondering What the HELL just happened here. I did my best and the case went on, with the lawyer shushhhing me the whole way!!

Someone help..... What can I do??? I could have done better myself, and I have to go back in march for the judge to set another date for her judgement.... I want to ask to have another trial... is this common? Does it happen?? What about the money in "TRUST"? am I able to get my cash back from the firm due to their lack of services?? What steps do I take?? It really burns my ass that I was clearly stereotyped by an officer, who made terrible notes, who I could have drilled in court...... where as I did nothing close to the stunt laws, and him and his buddies are trying to bang me for both..... BTW this was a rookie cop, my lawyer didnt find that out, the tow truck driver spit it out at the "freshest badge hes seen with the police contract"

I believe what they mean by the money is "In Trust" is that your money has been placed into a TRUST account operated by the traffic ticket company you are dealing with.


I may not be totally correct but I think it is a new requirement for all money taken by Paralegals to be first put into a TRUST account while the case is going on.

The only thing I can really recommend is, if you believe that your interests have not been properly represented by your hired counsel, talk to them directly. If they did "screw you over," I'd suggest discussing it with the Law Society of Upper Canada.
