Prohibition where evidence of inspection required
85. (1) No person shall operate or permit to be operated on a highway a vehicle of a type or class prescribed by the regulations made under clause 87 (a) unless the vehicle displays, affixed in the place and manner prescribed in the regulations, a device issued by the Ministry as evidence that the inspection requirements and performance standards prescribed by the regulations have been complied with. Where subs. (1) does not apply
(2) Subsection (1) does not apply to an operator of a vehicle of a class or type prescribed by the regulations who produces evidence that the vehicle has met the inspection requirements and performance standards of a reciprocating province or state designated by the regulations. Removal of plates by officer
(3) Where the device required by subsection (1) is not displayed as prescribed by the regulations, a police officer or officer appointed for the purposes of carrying out the provisions of this Act may seize the number plates of the vehicle. R.S.O. 1990, c. H.8, s. 85 (3).
Penalty
(4) Every person who contravenes this section is guilty of an offence and on conviction is liable to a fine of not less than $200 and not more than $20,000. 1996, c. 20, s. 20.
