No Insurance Card...

Good Morning, My son was recently stopped for speeding but also go a ticket for 'Fail to have insurance card'....he did have one but just not the current one. The officer went and spent 10 minutes checking and came back, told my son 'you do have insurance, just not the appropriate card' and proceeded to hand him his tickets and walk away....he got one of these tickets before and paid it now he can't get insurance on his own as his driving record shows that he was charged with driving with no insurance...but he only got a 65$ ticket then and paid it...what should he do?...should he fight the ticket and take his valid insurance card to court?...he has a letter from the insurance company stating that the car he was driving last time was indeed insured at the time...please any advice would be appreciated...thanks

this will be at the discretion of the prosecutor, they will most likely drop the insurance ticket in exchange for a plea-deal for the speeding ticket


unfortunately the insurance ticket won't be dropped because he did have valid insurance at the time; he got the ticket because he failed to produce an insurance card which showed valid insurance, when requested


Operator to carry insurance card

3. (1) An operator of a motor vehicle on a highway shall have in the motor vehicle at all times,

(a) an insurance card for the motor vehicle; or

(b) an insurance card evidencing that the operator is insured under a contract of automobile insurance,

and the operator shall surrender the insurance card for reasonable inspection upon the demand of a police officer. R.S.O. 1990, c. C.25, s. 3 (1).

I'd double check what his record actually says. Driving without insurance is a very serious offence, whereas driving without proof of insurance is not.
