Deposit Of Snow On Roadway - Section 181

No person shall deposit snow or ice on a roadway without permission in writing to do so from the Ministry or the road authority responsible for the maintenance of the road. R.S.O. 1990, c. H.8, s. 181.




For the purpose of this section 181 of the highway traffic act what is considered the roadway? Are the ditches on a rural road considered part of the roadway?

No, the definition of roadway under the HTA is the commonly travelled portion of the road. It doesnt even include the shoulders, so it certainly wouldnt include the ditches. They would fall under the definition of highway, but not roadway.

therefore I would not be violating the highway traffic act if I plow snow from my driveway across the road into the ditch? (again rural road, only farm field across the road. I am not plowing into someones yard)

You may (most likely) be violating a municipal by-law. What municipality are you in?
