Request For Disclosure - Enough Time?

Unread post by shablam »

Hi Guys,

I was involved in an accident in the summer. I got a careless driving ticket from the officer and my court date is in Mid February. I should not have taken this long to seek legal counsel but I did. I have signed up with OTT Legal to help me fight the ticket.

They mentioned they will make the Request for Disclosure by tomorrow. I read online however you should leave at least 9 weeks when making a request for disclosure. I paid OTT alot of money, however, I do not want to be shooting myself in the foot if I did not give enough time for them to make a case. Of course they would take on my case even if it were 1 week prior, since they just want money - so I figured i would ask the unbiased opinion of my fellow RFD'rs.

Is 5 weeks enough time for them to put this case together?

I cannot speak for any paralegal, nor do I want to speculate or comment on their actions. That would be inappropriate. If you have concerns with them, the best thing for you to do is talk to them directly. They'd be able to tell you a lot more than any of us would.

I will offer this, though. If your agent (or anyone else, for that matter) cannot get disclosure by the trial date, they can request an adjournment so that they can get disclosure before the full trial begins. In some cases, if the person has sufficient experience and knowledge, and the circumstances are right, disclosure is not even necessary.

* The above is NOT legal advice. By acting on anything I have said, you assume responsibility for any outcome and consequences. *
