60 In A 50

HI - I know this is for 16 - 29 over but I can't find the section for simple 10 overs.

Basically I got nabbed at a speed trap and the cop clocked me at 66 in a 50 but gave me a 60. At the time the police office said that he was leaving for the OPP and would not show up to court if I fought it. I decided to roll the dice. Unluckily he showed up to court.


I filed for an adjournment and stated the reason being that I wanted to ask for disclosure. The judge approved the adjournment and I filed for disclosure. My hopes are the next time I have court date he won't show up however that doesn't seem to happen as often as it used to.


What else should I do to get this baby thrown out?

Offence Date: April 19, 2010

Trial Date: March 21, 2011


Reading this site now I should have requested an 11B but I didnt know about that until today!

I'd say you won't be getting the 11B because the Adjournment was due to you wanting to request Disclosure (delayed because of you). Which is different from you previously requesting disclosure, and the prosecutor not giving it to you (delayed because of prosecution).
