No Speed Recorded On Ticket - Waiting To See Disclosure

Unread post by tcon »

Hi, I was pulled over in NS by an officer who was driving towards me in the other lane, and claimed I was doing 142 over the 100 limit. This resulted in a "Exceeding the posted limit by 31km/h or more" fine. Now the situation is, the officer never recorded my speed on the ticket, and if I can't find it in his notes when I receiver the disclosure, do I have a case? Is it required that he record the exact speed, or in the case of a 31km/h or more can they convict me based on him saying he judged my speed at 31 over?

I think the actual speed reading would have to be recorded somewhere in his notes to prove the offence. That is the norm though for a few east coast provinces; the tickets simply state you were going between X and Y over the limit, not the actual speed.
