Notice Of Fine Due Sent And License Suspended 3 Days Later
Hi I am new to this so sorry if I am not in the correct topic or format. I received a speeding tick in Ignace Ontario in October 2011, I chose to challenge is and was given a trial date of Feb 29, 2012. On Feb 28 due to my employment. I was unable to attend and spoke to two court clerks and the prosecutor to advise of my absence and asked if there was any way to either remand the date or just opt to pay the fine. They all indicated in quotes I say "we are in the 11th hour and unable to change or accept payment" I asked what me options are and are going to be they said they are unsure but a trial will continue and the fine of the ticket will stand along with a court imposed fine will be added. I asked how I will find out and go about paying this they said to call back tomorrow (feb 29, 2012) and the amount will be available. I did do that the court clerk said that because the trial has just ended at it was being held in Ignace and the paper work must go back to Dryden that the final documents would be type up and entered and a notice will the final amount will be mailed to me. No notice came. I received a due notice on May the 2nd (date of issue April 27) and a suspended license notice on May the 3rd (issued on April the 30th). I spoke back to the court in Dryden and they claim no clerical error has been done and that both the tick and suspension will stand. Furious I contact Attorney Generals office and they claim the only way to deal with the is with the origibal court in Dryden. The Attorney General agrees the timelines involved certainly are not in any way adequate notice for one to take responsibility in paying the amount. And a suspension notice issued 3 days after a notice is somewhat very extreem. I feel like I am dealing with an extemist in Dryden. What can I do and can I pursue legal action against the POA and or the court clerk or clerk manager personally for this. I have documentation and phone record indicating 4 seperate calls to the court house on Feb 28 and 29, 2012. So the discussions did indead take place. All I want is my license re-instated and the suspension retracted like in never happened.

Sounds like the court is actually caught up with all paperwork and running very efficiently, no back log like some courts in the south.

Best thing to do (and I'm not clear from your post), is pay the ticket and reinstatement fee first. At least that deals with problem #1. You can file to get it re-opened after that. At least, at that point, you are not suspended. You might want to consider talking to a paralegal or traffic lawyer about what your options are.
