Turn - Not In Safety. Advanced Green Light. Collision.
Family member was sitting at a red light, in the left turning lane.
Light changed to Green with advnaced green arrow.
We proceeded into the intersection and so did the car across the intersection. (facing us)
Yes, the other car is seeing a red light.
A collision occured. City police showed up and charged us with "Turn - not in safety".
The other driver was not charged.
Am I missing something here?
What should we be doing at this moment....??

Were you facing an advanced green arrow along with a circular green for traffic in the same direction? If so, as long as you can prove that you had the advanced green, the HTA does not require you to yield to through traffic - pretty much the only time that left-turning traffic ever has right-of-way over everyone else.
144 (13) A driver approaching a traffic control signal showing a circular flashing green indication or a solid or flashing left turn green arrow indication in conjunction with a circular green indication and facing the indication may, despite subsection 141 (5), proceed forward or turn left or right unless otherwise directed. R.S.O. 1990, c. H.8, s. 144 (13).

Correct. First car sitting at the red light waiting for the advance.
It was in Barrie.
Here is a link to the google street view of the intersection. The page should load to the way we were facing.
Please note: Google street view is from the right lane, We were going left from the left lane. Turning left infront of the "thrift store"

Looking at that google map, I can take a wild guess what your relative did wrong. They turned left and didn't maintain their lane. Not surprising. People do this each and everyday at this type of intersection.
When you turn left, you're supposed to stay in the centre most lane and then move over to the right when it is safe to do so. That's why they got the ticket.
The other person was perfectly within their rights to turn right on that red in Ontario since there were two lanes available.
