40 Km/h Zone
I'm charged with speeding 55 in a 40 km/h zone. Not a CSZ, just a 40. I understand that this 40 zone had to have been created by a bylaw specifically establishing it.
The bylaw hasn't been disclosed to me.
I have a feeling, reading what I have so far, that this might not matter. I see that it matters for Community Safety Zones, but am I correct in understanding that the bylaw and the regularity of it is assumed, in this case, by the existence of the signs?
The second part of my question is, the officer's notes have me at 60, so even if the 40 zone were invalid, I guess I would still be proven guilty of speeding 60 in a 50.
Do I have that right as well?
Thanks.
Re: 40 Km/h Zone
You can get the by-law through the city where the 40kph sign is posted. You can give them a call, and they may send you the by-law through e-mail.
