Trial Question

Hi,


I received a ticket for 30 over, I had a resolution meeting and they dropped in to 19 over pts $77 fine + surcharge.


I received a letter in the mail for trial, when I called it turned out they made a mistake and didn't have me present it to the JP. They are still offering the same deal but I need to drive back 2 hours again on the trial date to accept the deal.


Do I have any options here? or do I need to take another day off work and drive all that distance to accept this deal as is?

You do not have to do anything. If you do not take the deal it will go to court.


Sadly you need to drive back up or hire someone on your behalf.

The Provincial Offences Act does allow for pre-trial meetings and sentencing hearings to be conducted by telephone, but Im not sure if all Courts are doing so. Has the Crown specifically stated you need to attend in person? Or did you ask them about the possibility of a telephone conference call?

Thanks for the comments, the crown did inform me I needed to go back up in person and they were unable to do complete it over the phone.
