City Of Hamilton Trial Adjournment Request

Unread post by bandito »

Hi,

The city of Hamilton is asking that I attend court on the 27th of March for an adjournment to reschedule my trail on the bases that the officer who charge it is on Annual Leave. Just wondering what to expect and how to handle this.

If I were you I'd agree to it, but only if the JP notes that the delay is charged to the Prosecutor and not to you. This could, depending on how much of a delay you have, lead to an 11B for you down the road (check out Courts & Procedure section for the 11B stuff). Have you obtained disclosure for your case yet?

I had a para-legal start the case. He first requested an early resolution. Before the early resolution he requested disclosure but never received it. Then he his office office closed and I could not get in touch with him. I finally got in touch with him by phone and he said he was having problems in Hamilton and could not show his face but everything was under control. I showed up to the early resolution date and some other para-legal showed up in his place. This para-legal asked for discloser which the jp did not have. The para-legal then asked for a trail which was to happen this coming August. A few weeks ago I received the notice of adjournment. Tried to contact the para-legal but no luck. So I am going to show up in case my para-legal doesn't. Just wondering what I am to expect and how to handle it.
