Left Turn Whose Right Of Way

Recently driving with a friend when following scenario happens:

Car a is recently stopped at East-West road. Facing west (so on our right)

Car b in front of us, north bound on through way ( no stop sign)

Car c us, also north bound


Car b goes to turn right (east). We car c have our signal on to go left (west). Car b is about half way through their turn (so blocking view of car a). We start our left turn. Car a then tries to turn left (south) in front of us. Since we were turning, we weren't going fast. My friend straightens out and gives the guy (car a) a honk (who also stopped in middle of his left turn). We go straight around him and discuss who had right of way. So who? US in car c turning left with no stop sign. Or guy in car a turning left with a stop sign, but a car ahead if us was completing a right hand turn.


Also, if we were going straight. Would car a have right away since we in car c would wait the 2-5sec for car b to make their right hand turn? (A point we discussed)

Because he has the stop sign, he must yield right of way to you. If a collision occurred, he would be found 100% at-fault.

HTA S136(1)(b) - Fail to yield to traffic on through highway - $110 fine + 3pts


Stop at through highway


136. (1) Every driver or street car operator approaching a stop sign at an intersection,

(a) shall stop his or her vehicle or street car at a marked stop line or, if none, then immediately before entering the nearest crosswalk or, if none, then immediately before entering the intersection; and


(b) shall yield the right of way to traffic in the intersection or approaching the intersection on another highway so closely that to proceed would constitute an immediate hazard and, having so yielded the right of way, may proceed. R.S.O. 1990, c. H.8, s. 136 (1).

Thank you iFly, I take it this is the same if you are turning right or straight? That was the other point that came up as well.

I'll tell my friend I was right though :).

Correct - any driver with a Stop sign must yield to traffic on the road without the stop sign.
