“Can I Use 11b”

asking for a friend of mine:

He was charged with speeding 39 over in a 60 zone. offence date: Jan 13th, 2017; He requested early resolution, it was on August 20, 2017, then he request it to be adjourned until September 20, 2017. He went and refused the offer from the prosecutor. received new trial date: August 22, 2018. is 11b still applicable in his case? thanks in advance for any ideas or opinions.

11(b) only works when the delay is caused by the courts, the justice system, etc. Once he requested an adjournment, the delay became attributed to him. He'd probably be out of luck. Take out his one-month delay and he's really toeing the line on 18 months.
