Appeals Court Decision - Reserved...

Even after countless debates and several JP's and and even higher appeals court ruling that s.172

IS UNCONSTITUTIONAL, the rogue (agenda driven)

prosecutors (read persecutors) are still hell bent on one thing.

VENGEANCE!

Can someone tell me / speculate why these prosecutors are not acting dispassionately as they are

supposed to as set out by the guidelines from the UCLC rules [(duty as a prosecutor 4.01(3)

that governs the practices of provincial prosecutors?


I don't understand why they are not abating to general public and higher

court consensus?? Something starting to smell pretty rotten!

To these prosecutors, every ticket against them counts against them. That's why many will offer a reduced penalty if there is a prospect of them loosing. Doing one's job properly is a great motivator. Whoever said that a lawyer was a devil's advocate was right - there are criminal lawyers that make possible letting people go free from a murder trial.

Although there are a couple of judgements saying that the 50 over part of the legislation is unconstitutional, there's now another judgement from a few weeks ago saying that it's ok. Until a decision comes from a high enough court, you'll continue to see prosecutions.

...if it holds at higher it will remain, if not, the gov't will just reword...and go through the process again...

Anyone have any idea when the decision will be? I thought it was supposed to by the end of this month (February).
