My Vehicle Was Towed From A Private Parking Lot

Unread post by DrMidasRiff »

I had parked my vehicle in a parking lot (that was a closed for the day) furniture store. After leaving my vehicle, the Windsor police stopped and questioned me. It was found that I did not have my DL on me, no insurance, and no permit. I did provide them with my name and address, which qualifies as providing them with identification under the highway and traffic act. The police arrested me, and had my vehicle towed away. Now, the towing company has stuck me with a exorbitant bill, plus $20 a day storage, which is now close to $1000.

Can I sue the Windsor police for having my vehicle towed, it was on private property?

What remedies to I have here?

The short answer is yes, police do have the authority to tow vehicles from private property. They have to have some justifiable reason and a lawful authority to do so, but it's still possible off the roadawy. If you feel it wasn't justified in your case, I suggest consulting with a lawyer and seeing what they have to say.

I'd actually know what you were arrested for and if they actually laid any charges?
