Why 2 Schedules Of Fines In Ontario
According to the Highway Traffic Act s.128(14) the fine for 16-29 over the limit is $4.50/km. The Ontario Court of Justice Schedule 43, schedule B has the fine set at $3.75/km. Why is there a difference ? If my ticket is issued under the HTA, but my fine is calculated under the Ontario Court of Justice, is this considered an error on the ticket ?

I'm not sure the reasoning behind the two different fines, but it's not an error. Speeding tickets issued at the roadside always have the lower fine amount. If you're convicted in Court they can ask for the higher fine.

As I posted in another thread, there's 1 table for calculating fines based on speed for the purpose of the out of court fine on the Part 1 certificate and another for calculating the fine after trial.
