Passed On The Left - Looking For Advice
Hello,
I was in a traffic collision recently. I was travelling on a single lane road with a solid yellow line. I signaled to begin a left turn into a driveway. The other motorist behind me decided for whatever reason to pass me on the left (oncoming lane) which struck my left bumper and messed up my alignment as I made the the turn.
The insurance adjuster is claiming it is a 50/50 fault. Is this right?

From what you said, IBC rules state the other driver is 100% at fault

Its dependent on where you were turning (intersection versus driveway) and if there were additional vehicles behind you that the other motorist passed.
Sections 10(5) through 10(7) in MegaSilvers link cover the various scenarios. You could be 0%, 25% or 50% at fault. Based on what you said it sounds like you would be 50% at fault.
