“Summons 3 Court Date On Ticket Incorrect”

I received a hand held device summons 3 back in sept. The scheduled date to appear on the summons that the officer gave me was Monday Oct 9.

On Sat Oct 7 I had a police officer knock on my door to tell me that the officer who gave me the summons didn't realize the courts were closed that day. The officer who gave me the summons asked this officer to come to my door to tell me not to show up at court on the Monday because it wouldn't be open.

I asked the officer who came to my door when I would be receiving a new court date. He told me a summons officer would show up at my door with a new date.

Its now been more then 2 weeks and I have not received a new summons. How long does the court have to deliver a new one to me?

They have six months from the date of the offence to serve a summons.

Is this a fatal flaw that I was only told on the Saturday and my court date was Monday that the court wouldn't be open?

No

I got a summon and on the date of the trial none of the officer and the witness showed up in the court room, however, the prosecutor still pressed for a guilty plead and then an adjournment.
