“Research Help Needed - Motorcycle Passengers”

I am doing some independent research on Bill 117 and heard that there already is a piece of legislation where a motorcycle passenger has to be able to reach the pegs. A search of the HTA yielded no results for me. Does anyone know the specific act/section in question?

I would go with common sense.

If someone is too small they will let you know..

Ill have to agree with Viper mind you most cops use common sense to.

I mean don't go take a toddler on a motorcycle on a 400 series highway going 50 over the limit.

If an officer pulled you over doing something like that i am sure your gonna get the book thrown at you.

I mean if your cruising around a small local street with a 10 year old who may be a bit small you might get a stop making sure everything is safe and he might give you some kind of warning....

it really depends on the situation and how the officer takes it.

If you really doing something to stick out i am sure they might say something.

Thanks guys but I'm looking for the specific legislation to show that there already is a law protecting children too small to reach the pegs and that further legislation is not needed.

REG. 596 s. 10 (3):

10. (1) No person shall operate upon a highway a motorcycle or motor assisted bicycle equipped with handlebars that are more than 380 millimetres in height above the uppermost portion of the seat provided for the operator when the seat is depressed by the weight of the operator. R.R.O. 1990, Reg. 596, s. 10 (1).

(2) No person shall be carried as a passenger on a motorcycle operated on a highway except,

(a) in a side car designed to carry a passenger; or

(b) subject to subsection (3), on a seat that is situated to the rear of the seat provided for the operator and that is securely fastened to the motorcycle, which shall be equipped with foot rests for the passenger. R.R.O. 1990, Reg. 596, s. 10 (2).

(3) A person who is a passenger on a motorcycle operated on a highway and who is occupying the seat referred to in clause (2) (b) shall sit astride the seat in such a manner that his or her feet are placed upon the foot rests referred to in clause (2) (b). R.R.O. 1990, Reg. 596, s. 10 (3).

The charge would be "Passenger improperly seated on motorcycle".

Thanks Squishy. I can't believe that Jaczek is still pushing her dumbass law even after all of the evidence that it'll have absolutely zero contribution to passenger safety and that there already is a legislation in place to protect really small children. Well I can. She's a politician and she's doing it for "think of the children" votes.

One of the few memories I have from before I was 5 was riding on the gas tank of my dad's bike. I was allowed to play with the horn when no one else was around. When roads were busy or my mom was around, I sat sandwiched between my parents. The bike was sold around the time I was four, and I raised such a ruckus that my dad borrowed a friend's bike to take me around 'one last time'.

We still have pictures of me sitting up front, sans helmet. Better keep those away from the media.

I remember being taken on the back of my big cousin's Tomos Automatic (50cc scooter) at the age of 12. Same story, no helmet, no gear. Ended up riding it for a few days too. That was the first and only time I ran away from cops.. Got away clean too.. By the time they aborted their traffic stop, I was already around the corner and even though I ran out of gas on the way down to the cousin's house, I had enough forward momentum to pull into the yard, into the garage and close the door behind me

As for my friends, they spend quite a bit of money to outfit their kids with high quality lids and good leathers before they let'em get on the back of the bike. Ofcourse, their riding style's extra careful when they take the kids on the back. That's why I got so royally pissed when I originally heard of 117.
